Inspector’s narrative

What the inspector wrote

Licensing Program Analyst (LPA) Melanie Otsuji arrived to the facility unannounced to conclude investigation into the above allegations. LPA was met by Director, Lily Talamantes. Also present during today's visit were 9 additional staff members and 45 preschool aged children. Based on obesrvations and record review, the larger dirt king children's tricycles used on the younger preschool aged play yard is not age appropriate as manufacturer specifications state it is for ages 4-6 years. And although some children in the younger preschool aged classrooms may be tall enough, they are not old enough to utilize the tricycles per the manufacturer. Based on LPAs observations and record review(s), the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Health and Safety Code 1596.80 is being cited on the attached LIC. 9099D. An exit interview and report reviewed with Director, Lily Talamantes.

All play equipment and materials used by children shall be age-appropriate.This requirement is not being met as evidence by: LPA observed Dirt King (DK-250-R) tricyles on the play yard. Per manufacturer specifications, this particular model of tricyle is for ages 4-6. This play yard was for the younger preschoolers (2-3 year olds). This has the potential to be a health and safety risk to children in care.
