What the inspector wrote

Licensing Program Analysts (LPAs) Deanna Villagrana and Elizabeth Berumen met with licensee Abelicia Gaeta for a required one year visit. LPAs explained the nature of today’s inspection to her. Present were licensee and nine day care children. Another day care child arrived five minutes later. Licensee was alone and had 10 day care children including two infants. Licensee was out of ratio. Days and hours of operation are Monday to Friday, 6:00am to 6:00pm. The adults that reside in the main home are licensee, her husband, two adult sons, Gilberto Gaeta and Humberto Gaeta. Licensee states her daughter in law Maria Carmen Perez stays in the home with her 8 month old child on the weekends. The home has a studio in the back of the home in which licensee states she rents out. Licensee failed to report the adults living in the home. A review of staff records on 02/22/2022 indicates that not all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. LPA observed Alicia Garcia and adult daughter Alicia Garcia do not have fingerprint clearance. Deficiency was cited on separate LIC9099 report dated 02/23/2022. Licensee Abelicia Gaeta was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPAs toured the indoor and outdoor areas of the home during today’s inspection. LPA observed that the home is clean and orderly, with heating and ventilation for safety and comfort of the children. LPAs observed a barricaded fireplace in the home. LPAs observed safe and sufficient materials, toys, and play equipment for the day care children. All sharp objects, detergents, cleaning compounds, medications, poisons, and other similar items inside the home are stored inaccessible to children. LPAs observed a fully charged 3A40BC fire extinguisher. LPAs observed a working combo smoke and carbon monoxide detector. Licensee states there are no weapons/firearms in the home. Off limit areas indoor: master bedroom/bath, bedrooms 1 and 3, one bathroom and attached garage. There are no bodies of water. Backyard is fenced. Off limits outdoor: left side of home that is fenced off to children and back studio. Licensee states there are no animals in the home. LPAs observed licensee and her husband have a current CPR and First Aid certification expiring 09/04/2022. Licensee and her husband have not completed Mandated Reporter training. LPAs did not observe a current roster of the children. Child 8 was not listed on the roster. LPAs observed a fire and disaster drill log which was last completed on 01/28/2022. LPAs reviewed 13 children's files and observed all forms are completed and children have current immunization records. LPA's observed two infants did not have LIC9227 on file at time of enrollment. Infants are now over 12 months. Licensee states day care is not insured. LPAs discussed SB792 Immunization Requirements and observed licensee and her husband have immunization records on file. Supervision of children was discussed with licensee and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands her capacity options and she understands that she cannot have more than 14 children in the home at any time. Licensee understands if she transports children via vehicle, children cannot be left in parked vehicles unattended at any time. Nine children between the ages of 2 and 7 were observed without face coverings. On 02/23/2022, licensee failed to ensure the personal rights of children in care to safe and healthful accommodations, and engaged in conduct inimical to the health, welfare, and safety of children in care, in that facility staff Abelicia Gaeta did not wear face coverings indoors as required by the State Public Health Officer Order dated June 11, 2021, requiring compliance with CDPH Guidance for the Use of Face Coverings and the Cal/OSHA COVID-19 Prevention Emergency Temporary Standards (ETS). An exemption to the Order requiring face coverings did not apply. LPAs observed licensee did not have a Safe Sleep log for infants in care. LPAs discussed the safe sleep regulations with licensee Abelicia Gaeta and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAs also informed licensee Abelicia Gaeta of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPAs discussed Zero Tolerance related regulations with licensee Abelicia Gaeta and was advised of the assessment of $500 immediate civil penalty and an ongoing $100 per day per violation continues until the violation(s) is corrected. Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Exit interview conducted and report was reviewed with the licensee Abelicia Gaeta. The following type A and B deficiencies were cited on the attached page (809-D). Licensee was informed that failure to correct the deficiencies by the specified Plan of Correction (POC) Due Date may result in assessment of civil penalties in the amount of $100 per day per violation until the correction is made. LPAs Deanna Villagrana and Elizabeth Berumen informed licensee Abelicia Gaeta that this report dated 02/23/2022 documents two Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPAs Deanna Villagrana and Elizabeth Berumen informed the licensee Abelicia Gaeta to provide a copy of this licensing report dated 02/23/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day they children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be place in the child's file for verification. A notice of site visit was given and must remain posted for 30 days.

    This requirement was not met as evidenced by Licensee rents out the studio in the back of the home to Alicia Garcia and her adult daughter Alicia Garcia who do not have fingerprint clearance. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
