What the inspector wrote

Licensing Program Analyst (LPA) James Santos conducted an unannounced subsequent complaint investigation at the facility today and met with Director, Hui Ren. The purpose of today's visit was to deliver the investigation finding for the above allegation. During the couse of the investigation, LPA conducted interviews with staff, parents and children. Per interview with other staff, they have not seen staff (S1) hurt the children. Per interview with the children, they stated the teachers do not hurt them. Per interview with the parents, they do not think that the teachers would hurt the children and they have not seen any injuries on their children. Also, a case was filed with the Campbell PD in regards with the allegation and a copy of the police report was obtained and reviewed by the Department. Per police report, the video footage did not show any over act of abuse by staff. Based on the information gathered, there was not enough evidence to prove the above allegation, therefore the allegation was UNSUBSTANTIATED. A finding that is unsubstantiated means although the allegation may have happened or is valid, the preponderance of evidence does not prove it. No deficiencies cited. Exit interview conducted and report was reviewed and a copy was provided to Director, Hui Ren. NOTICE OF SITE VISIT WAS ISSUED AND MUST REMAIN POSTED FOR 30 DAYS.

    101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons.This requirement was not met as evidenced by: Per review of the video footage, it was observed that staff (S1) picked up child (C1) by grabbing both his arms and carried him over in the circle time area. S1 was seated and used her knees to prevent C1 from turning or leaving. C1 sat for a while then stood up and S1 responded by lifting him up and sat him back on the floor. This poses a potential risk to the Health, Safety or Personal Rights to children in care.
