What the inspector wrote

Based on the record review in the facility’s admission agreement, a statement under “rest period” (which means sleep period) stated that “all children will participate in a rest period, and on the LPA’s conducted interview, it confirmed that the children’s were “forced” to only stay in the “napping area” during sleep periods. The Licensee is in violation of Section 102423 Personal Rights, (4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. The preponderance of evidence standard has been met; therefore, the above allegation is to be SUBSTANTIATED. LPA Estoesta informed the facility representative that this report dated 12/17/2025 included a Type B Citation as there is a potential risk to the health and safety of children in care. This requirement is not met as evidenced by, based on the record review in the facility’s admission agreement, a statement under “open door policy” stated that “at this time and until further notice, families will not be allowed into the facility,” and on the LPA’s conducted interview, it confirmed that the children’s authorized representatives were not allowed to enter the home. This poses a potential risk to the health and safety, of the children in care.
