Personal Rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting. This requirement is not met as evidenced by: Occasionally a child was forced to nap or/and sit on eating table bench during nap time or/and meal time that the facility did not comply with the section cited above which posed an potential health, safety or personal rights risk to persons in care.

Personal Rights: Each child shall be accorded dignity in his/her personal relationships with staff, and other persons. This requirement is not met as evidenced by: The Facility had an incident in which in between staff had a verbal argument in front of day care children.

Limitations on Capacity and Ambulatory Status: The licensee shall not exceed the conditions, limitations and capacity specified in the license. This requirement is not met as evidenced by: the facility was using its preschool classroom for a non-CCL program that the facility did not comply with the section cited above which posed an potential health, safety or personal rights risk to persons in care.

No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Children were left alone unsupervised during the early drop off when staff took children temperature outside the classroom with door closed that the facility did not comply with the section cited above which posed an potential health, safety or personal rights risk to persons in care.
