What the inspector wrote

Licensing Program Analyst (LPA), James Santos conducted a case management and met with Licensee, Robert Regan. LPA discussed with Licensee of the applicable civil penalties for those adults who have not received fingerprint clearances, are not associated to the license and who come in contact with or provide care and supervision to the children. Penalty amounts: $100.00 per person per day, minimum of $100.00 to a maximum of $500.00 per person for an initial violation and a minimum of $100.00 to a maximum of $3000.00 per person for any subsequent violations within a 12 month period. A review of staff records indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. However, three (3) of the staff were not associated to the facility. As a result, a citation was issued and civil penalty assessed. Appeal rights printed and reviewed with Licensee. A NOTICE OF SITE VISIT WAS ISSUED, POSTED NEAR THE ENTRANCE TO THE FACILITY, AND MUST REMAIN POSTED FOR 30 DAYS.

    Criminal Record Clearances: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f) This requirement was not met as evidenced by: Staff members have clearances but not associated to the facility. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.

    PERSONNEL REQUIREMENTS

    Personnel Requirements:At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities. This requirement was not met as evidenced by: Per review of record, all staff did not have a valid Pediatric CPR/First Aid certification. This poses a potential risk to the health and safety of children in care.

    On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement was not met as evidenced by: Per review of record, all staff did not have a valid AB1207 Mandated Reporter Training certification. This poses a potential risk to the health and safety of children in care.
