What the inspector wrote

On 5/28/25 at 8:35AM, Licensing Program Analyst (LPA) Angela Luz met with Licensee Hengameh Mirilavasani to conduct an unannounced annual RANDOM inspection. Present for this inspection was 10 children (4 infants and 6 preschool aged children) and 1 fingerprint cleared assistant. The home was toured to conduct a Health and Safety Inspection. Days and hours of operation are Monday \342\200\223 Friday 8AM to 5PM. Facility: Licensee toured the facility with LPA. The ON LIMIT AREAS are the play room, dining room, bedroom 1 and 2, bathroom in the hallway, and backyard. The OFF LIMIT AREAS are the kitchen, living room, primary bedroom and bathroom and laundry area. Off limit areas are inaccessible by closed and/or locked doors and visual supervision. Children are escorted by Licensee and assistants through the living room to access the backyard. The home is neat and clean with heating and ventilation for safety and comfort. The ISOLATION AREA is bedroom 1 if children are inside, or a bench in the backyard if children are outside. The outdoor play area is free from defects or dangerous conditions and is fully fenced. LPA observed a large, stable play structure with swing and slide components with turf underneath. LPA observed that the slide was steep and advised to add padding underneath as an additional safety measure. There have been no changes from the areas previously identified as OFF LIMITS or alterations to existing building or grounds. There are no bodies of water. All hazardous materials and toxins are kept out of the reach of children. Licensee understands that any materials that are labeled \342\200\234Keep out of reach of children\342\200\235 or have similar messaging should be kept out of reach from children in care. Licensee states that there are no firearms in the home. The home has a fully charged 3A40BC fire extinguisher that was last serviced on 10/9/24, working smoke detector, working carbon monoxide detector, and working telephone. Licensee states that G.R.I.M. Fire services the fire extinguisher once a year. Care and Supervision : There are ample age-appropriate toys that appear to be safe and in good condition. Licensee uses redirection, talking with the child, and time out as forms of discipline. Licensee informed LPA that during time outs they sit with the child and talk with them, explaining what happened. Licensee states that time outs are no longer than 2 minutes and LPA reminded that best practice for time outs is one minute per year of age maximum. Licensee understands that children's personal rights should not be violated, including but not limited to, no corporal punishment, interference with eating, intimidation, or other actions of a punitive nature. Children are treated with dignity, receive safe, healthful, and comfortable accommodations. LPA reminded that Licensee is required to be present for 80% of operating hours per day. Licensee understands how to report Unusual Incidents/Injuries. LPA observed 3 play yards. The play yards do not hinder entrance or exit to and from the space where infants are sleeping. 1 of 3 mattresses in play yards are firm and covered with a fitted sheet that is appropriate, fits tightly, and overlaps the underside of the mattresses. LPA observed that 2 of 3 of the mattresses in the play yards were beginning to get softer and advised Licensee to purchase replacements. Each infant\342\200\231s bedding is used for them only and cleaned weekly or before use by another infant. There are no loose articles and objects, bumper guards or objects hanging above or attached to the side of the cribs or play yards. Licensee understands Infant Safe Sleep requirements. Records: Licensee took the online portion of Pediatric CPR and First Aid on 9/26/23 with American Red Cross. LPA reminded Licensee that they are required to also take the hands-on course to meet licensing requirements. Licensee Mandated Reporter Training for Child Care Providers is current and expires 4/16/26. Licensee was reminded Mandated Reporter Training (AB1207) and CPR/First aid certifications needs to be renewed every two years. A copy of the licensee\342\200\231s immunization is on file. The Licensee conducts and documents fire and disaster drills every six months, last drill was on 1/6/25. A current copy of the facility roster was viewed, and a copy was obtained. Licensee carries liability insurance that expires 9/27/25. Entrance checklist for Family Child Care Home was provided and licensee was reminded of documents to be posted in a prominent, publicly accessible area of the facility. LPA reviewed the assistant\342\200\231s file for the following records: Employee rights (LIC 9052), Statement Acknowledging Requirement to Report Child Abuse (LIC 9108), immunization records, and required training. The assistant\342\200\231s file is complete. LPA reviewed six (6) children files during today's inspection for the following records: Notification of Parents Rights (LIC995A), Consent for Emergency Medical Treatment (LIC627), Identification and Emergency Information (LIC700), and Immunization records. Children\342\200\231s files were missing the California Pre-Kindergarten and School Immunization Record and LPA reminded Licensee of their responsibility to update this document each time the child receives vaccinations. Each infant under 12 months of age has an Individual Infant Sleeping Plan maintained in the file signed and dated by the infant\342\200\231s authorized representative. Documentation of infant sleep checks every 15 minutes that notate any signs of distress are maintained in their file. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/ safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. During the exit interview, the LICENSEE, Hengameh Mirilavasani, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Megan's Law was checked on 5/21/25. During today's inspection, 1 Type B deficiency is issued on attached page 809-D: Licensee Pediatric CPR and First Aid certificate does not meet Licensing requirements. 3 advisory notes are issued. Mattresses shall be firm. Update each child's California Pre-Kindergarten and School Immunization Record. Add padding underneath the slide. Appeal rights were provided. A notice of site visit was given to licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Exit interview conducted and report was reviewed with the licensee Hengameh Mirilavasani.
