What the inspector wrote

Licensing Program Analyst (LPA) Mel Matos conducted an announced prelicensing inspection and met with Kathy Abady, Program Director/Director. The Applicant, Catalyst Family Inc, is applying for a License to operate a School Age Center with a capacity of 70 at 750 Lakechime Drive, Sunnyvale, CA 94089. The School Age Center will be operating in Rooms Y1 and Y2 on a functioning elementary school site: Lakewood Elementary School. The School-Age Center will operate Monday through Friday from 6:30 AM to 6 PM, serving children ages K-5th grade. The Facility has a working telephone: (408) 769-4106. The School Age Center will be operating on a functioning school site and thus is exempt from the requirement of square-footage for indoor and outdoor activity space, toilets/sinks, fencing, and isolation space requirements for child day care centers, pursuant to Health and Safety Code Section 1596.806. A copy of the capacity letter from the Sunnyvale School District confirming the capacity of 70 school age children is on file. A fire safety inspection approval was received from the Sunnyvale Department of Public Safety on July 28, 2021. The fire inspection indicates that Room Y1 is for ages TK to 2nd grade and Room Y2 is for ages 3rd to 5th grade. LPA also observed that the facility has fire extinguishers, carbon & smoke detectors, and first aid kit. Rooms Y1 and Y2 and the outdoor areas were inspected during today's inspection. The children will be using part of the elementary school playground (one directly outside Rooms Y1 & Y2 and one in the middle of campus) for outdoor activities. LPA observed that the Facility has a supply of play equipment for outdoor activities. The outdoor activity space is enclosed with fencing and there are shaded areas for children. There are play structures in the elementary school playground areas that are age appropriate and has adequate resilient materials (rubber surfacing). Bathrooms for boys and girls are located between Rooms Y1 & Y2. The bathrooms are separate and provide individual privacy. Children will bring individual water bottles and the Center also has portable water dispensers & disposable cups to ensure that drinking water is available. There is sufficient furniture (including tables & chairs) and equipment for children to use in both Rooms. There are no weapons in the Facility. LPA did not observe any bodies of water on campus. The Facility will not provide transportation. The Center will provide breakfast and snacks during the school year. The Facility will provide lunches when operating full day (during school breaks). The Facility has a microwave, dishwasher, & refrigerator for food preparation/storage. LPA observed containers for storage of solid wastes with tight-fitting covers. Detergents, cleaning compounds, sharps, medicines, and other items which could pose a danger if readily available to children are stored where they are inaccessible to children in care (out of reach and locked cabinets). The Facility will use a third party cleaning service to clean the Facility. This Facility plans to provide Incidental Medical Services – IMS. A Plan of Operation that includes IMS is on file. LPA also provided the following information regarding ADA to Kathy: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care centers and the ADA, available at: http://www.ada.gov/childqanda.htm . LPA discussed the most current COVID-19 guidelines issued by the State (COVID-19 Updated Guidance: Child Care Programs and Providers) and the Santa Clara County Public Health Mandatory Directive for Programs Serving Children or Youth with Kathy. All individuals subject to a criminal record review (Kathy Abady, Program Director/Director) have obtained a criminal record and child abuse index clearances prior to today's inspection. LPA reminded Kathy of the applicable civil penalties for those adults who have not received fingerprint clearances, are not associated to the license, and who come in contact with or provide care and supervision to the children. Penalty amounts: $100.00 per person per day, minimum of $100.00 to a maximum of $500.00 per person for an initial violation and a minimum of $100.00 to a maximum of $3000.00 per person for any subsequent violation within a 12 month period. LPA discussed the requirements of AB 633 with Kathy. Kathy understands the AB 633 fact sheet/copy of Acknowledgement of Receipt of Licensing Reports (LIC 9224). LPA discussed "zero tolerance" related regulations with Kathy and advised her of the assessment of an immediate $500 per day civil penalty for any violation of a "zero tolerance" related regulation. An ongoing civil penalty of $100 per day continues until the violation(s) is corrected. Exit Interview was conducted with Kathy and advised her that a license for 70 school age children in Rooms Y1 & Y2 is approved effective today, August 12, 2021.
