What the inspector wrote

*This report is amended to include additional measurements for Room 3 to the original report . Licensing Program Analysts (LPAs), Farida Raja and Harsimran Kaur conducted an unannounced pre-licensing inspection for a change of ownership at this facility. LPAs met with Applicant/ Director, Varsha Kumar and explained the purpose of today’s inspection. The applicant is applying for a preschool license for 56 children ages 3-6 years with a toddler component for 32 children, ages 18-36 months. The center will operate Monday through Friday from 7:30 AM to 6:00 PM. A fire clearance approval from the San Jose Fire Department was granted for 88 children on 10/032023. LPAs toured and measured the indoor and outdoor areas of the facility during today's inspection. Indoor Activity Space: ROOM 1: 20.00 X 18.42 minus 13.3 (encumbered space) = 355.1 ROOM 2: 24.75 X 21.08 minus 13.3 (encumbered space) = 508.43 ROOM 3: (21.83 X 14.00) + (7.83X 5.17) minus 17.97 (encumbered space) = 328.13 ROOM 4: 39 X 26.75 minus 39.42 (encumbered space) = 1003.83 ROOM 5: (20.25 X 10.67) + (29.33 X 22.33) minus 14.98 (encumbered space) = 856.03 TOTAL INDOOR SPACE = 3,051.52 sq. ft. divided by 35 = 87 children LPAs observed a fully charged fire extinguishers, centrally connected smoke and carbon monoxide detectors and appropriate lighting in each classroom. The facility has central heating and air conditioning. The facility has 6 sinks (90), 6 toilets and 1 urinal (105) available for the children. The sinks to be used by children only have cold running water. Staff bathroom is located in the toddler room. The sick children will be using the staff bathroom if needed. Sick children will be isolated in the Director's Office and isolation equipment will be provided. Continued on Page 2 Director stated that medication for children will be stored in the office. LPA observed a refrigerator in the office and director stated that If medication requires refrigerator it will be stored in the office refrigerator. Staff and children's bathrooms are clean, sanitary, and operable. LPAs observed containers with tight-fitting lids for the disposal of solid waste in all classrooms. First aid supplies are stored in Rooms 2 and 4 in high cabinets inaccessible to children. Cleaning supplies are stored in high cabinets in the bathrooms and in a locked closet in Preschool Room 4. Director stated that there are no weapons or firearms on the premises. LPAs observed that all furniture and equipment indoors are in good condition and safe for the children. The facility will not be providing meals. Parents have the option to purchase hot lunch from an outside vendor (School Caterers) or bring their children's lunch. Director stated that facility will provide snacks. The facility has an off-limits kitchen in Preschool Room 4. The kitchen is clean and equipped with a sink, refrigerator, microwave and storage space for food. Disposable utensils and plates will be utilized by the facility. Drinking water will be readily available for the children indoors via individual water bottles and drinking fountains. Transportation will not be provided by the facility. There are 10 tables, 101 chairs, 84 cubbies, 48 cots for the children. Director stated that they have more cots and sleep mats in storage. There is adequate supplies and toys for the preschool children in each classroom. OUTDOOR MEASUREMENTS: PLAYGROUND: 20.08 X 11.75 = 235.94 62.25 X 25.33 = 1576.79 17.50 X 68.42 = 1197.35 PLAYGROUND TOTAL = 3,010.08 minus 0 (encumbered space) = 3,095.193 TOTAL OUTDOOR SPACE = 3,010.08 sq. ft. divided by 75 = 40 children LPAs observed that the playground is surrounded by appropriate fencing and the outdoor surfaces are safe. Shade is provided by trees and building overhang. Director stated that they have 2 umbrellas in storage that will be used on hot weather days. Continued on Page 3 The areas under and around the play structure is cushioned with rubber foam that will absorb a fall. Drinking water will be provided by individual water bottles and refilled using the drinking water fountains. No bodies of water were observed. Director submitted a waiver for the shared playground space for preschool and toddler children including outdoor schedules for both. Director was reminded that initial lead testing results shall be received within 180 days from licensure. Following the initial testing, facility must conduct water testing every 5 years after the date of the first test. Incidental Medical Services (IMS) policy was discussed. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice) or (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm Director were reminded that all adults 18 and over, responsible for the administration or direct supervision of staff, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPAs reviewed with Facility Representative the LIC 311A, Records to Be Maintained at The Facility, for child’s records, personnel records, administrative records, and documents to be posted. Assembly Bill (AB 633) was discussed with Facility Representatives. Facility Representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and resource and referral agencies (R&R) throughout California. LPAs advised director that a license for 86 children will be submitted to management for approval upon receiving the Financial Information Release and Verification Form (LIC 404) from applicant's bank.
