What the inspector wrote

Licensing Program Analysts (LPAs) Marilou Monico and Jaime Gonzales conducted a Case Management Inspection in response to Licensee's request to add an outdoor playground space for the preschool program. LPAs met with Site Director, Matt Linden. A tour of the facility was conducted and census was taken. LPAs also measured the outdoor space available for the children. Outdoor measurements taken today: Play Yard: 87.75 x 71.00 = 6,230.25 15.50 x 21.42 = 332.01 Play Yard total = 6,562.26 (6,230.25 + 332.01) minus 587.09 (encumbered space) = 5,975.17 Outdoor measurements taken by LPA Kaur on 12/19/23: Preschool Yard (outdoor space adjacent to Room 30/31) = 6114.99 TOTAL OUTDOOR SPACE: 12,090.16 (5,975.17 + 6114.99) divided by 75 = 161 children Site Director stated that the preschool children will be sharing the Play Yard with the Kindergarten children of Tessellations Elementary School at different times. A waiver request was submitted to Licensing. There is a climbing structure in the Play Yard. LPAs observed cushioning (tanbark) under and around the structure. LPA did not observe playground safety stickers with designated ages on the climbing structure. Continuation on next page: LPAs observed that three staff members (S1, S2 & S3) do not have fingerprint clearances associated to the facility. Civil penalty of $300 was assessed. Site Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. The following items must be completed prior to using the Play Yard for the preschool children: 1) Waiver approval to share the Play Yard with the Tessellations Elementary School children 2) Proof of playground safety stickers with designated ages on the climbing structure or user's manual of the same type of structure showing the age range of children who can use the structure. As a result of this inspection, Type B deficiency was cited on the following page. Exit interview conducted and report was reviewed with Site Director, Matt Linden. Appeal rights was provided to Site Director. A Notice of Site Visit was issued and must remain posted for 30 days.

    Criminal Record Clearance - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department or(2) Request a transfer of a criminal record clearance as specified in Section 101170(f) . This requirement was not met as evidenced by: LPAs observed that three staff members (S1, S2 & S3) do not have fingerprint clearances associated to the facility. This poses a potential risk to the health, safety and personal rights to children in care.
