What the inspector wrote

Throughout the investigation process, it was found the allegation is SUBSTANTIATED; based on interviews, observations, and information gathered by LPA. A finding that is SUBSTANTIATED means the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. As a result, one type B deficiency was cited on the following page and copy of Appeal Rights was given. Exit interview conducted in Mandarin with Licensee, Yaping Bai. A notice of site visit was issued and must remain posted for 30 days.

    Health and Safety Code section 1597.465 states:A large family day care home may provide care for more than 12 children and up to and including 14 children, if all of the following conditions are met:... (b) No more than three infants are cared for during any time when more than 12 children are being cared for.This requirement was not met as evidenced by:Based on LPA observations, reocrds review and interviews, that licensee stated she had 13 children (including 4 infants) in April. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
