What the inspector wrote

On 8/14/2024 at 12 pm, Licensing Program Analyst (LPA) Manel Estoesta conducted an unannounced Annual / Random Visit. LPA met with the Director Marilou Sola and explained the nature of the visit. Present on this visit were 12 Staff, 13 Toddlers and 45 Preschool Children. The facility operates from Monday to Friday 8am to 6pm. There are 4 classrooms that are the licensed rooms. This Preschool has a Toddler Option operating in Room Orange. The Preschool Is operating in the Rooms Red, Yellow and Green. Facility\342\200\231s License, Parents\342\200\231 Rights Poster, Personal Rights, Activity Schedules, Menus, PUB 269 and LIC 610 were observed to be posted. Facility was observed to follow teacher to children ratio requirement during LPAs' inspection. Children were engaged in various activities under the visual supervision of the teachers. The classrooms, restrooms, kitchen, pantry, storage room, and office area were inspected. Director stated that facility does not possess nor store any weapons on the premises. Disinfectants, cleaning solutions, and other items that are dangerous to children were stored inaccessible to children. Cabinets, drawers, and rooms used for storage were locked. Furniture and equipment such as mats, cots, tables, diaper changing tables and chairs were age appropriate and were in good condition, free of sharp, loose, or pointed parts. Restrooms for children's use were observed to be in safe, sanitary, and functioning condition. Floors were clean and free from tripping hazard. Outdoor activity space is fenced and was inspected. The play equipment was maintained in a safe condition and free of hazards. There were no bodies of water observed. Areas around and under high climbing equipment and slides were cushioned with material that absorbs falls. There were shaded rest areas for children. Drinking water are arranged to be readily available to children during indoor and outdoor activities. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing is pending in accordance to the Written Directives outlined in PIN 21-21.1-CCP. Facility files were reviewed. Facility is currently using an electronic sign in and out system application with \342\200\234Procare.\342\200\235 Children sign in logs for today were reviewed and LPA obtained copies. LPA observed Smoke and Carbon Monoxide Detectors, fire pull stations, fire sprinklers and fire extinguishers. LPA observed the facility's current fire inspection permit from the City of Milpitas dated 3/6/2024. The facility's Earthquake Drill and Fire Disaster Drills conducted on 1/12/2024 and 4/16/2024. Facility does not provide transportation for children, but Director understands that children cannot be left alone, unattended in park vehicles. A sampling of Children's files was taken for review. The records reviewed include Admission Agreement, Identification and Emergency Information, Sleep Logs, Diaper Changing Log, Activity Log, Medical Assessment, and Immunization. LPA obtained copies of the Facility's Children's Roster. Director stated that facility does handle medications and does currently have children in care who requires Incidental Medical Services - IMS Epinephrine and Inhaled Medication. LPA reviewed storage of medication and equipment/supplies, and reviewed children\342\200\231s, personnel, and administrative records. A sampling of Staff's files was taken for review. LPA reviewed staff current certification in Pediatric CPR and First Aid, Child Care Providers, Staff Immunization and TB clearance, and Staff Educational Units were verified. LPA obtained copies of an updated LIC 500. The Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. The Director was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. There were no violation of Title 22 regulation observed today. No deficiency/ies cited today. A notice of site visit was given to the Director and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. The Licensee arrived at the facility at 2pm. LPA met with the Licensee and explained the nature of the site visit. The Licensee left at 2:45 pm. Exit interview conducted and report was reviewed with the Director Marilou Sola.
