What the inspector wrote

Licensing Program Analyst (LPA) Elizabeth Larios met with Licensee, Martha Da Silva for an unannounced Required - 3 Year inspection. LPA was granted access to the home by Licensee, Martha. LPA observed ten day care children present in the home. Present in the home was Licensee, Martha, Assistant, Luz Jimenez Hernandez, and Licensee adult son Daniel Da Silva during today's inspection. Licensee was operating within her capacity and ratio requirements. LPA observed the required postings, including the facility license, near the front entrance of the home. Days and hours of operation are Monday - Friday from 6:00 AM to 6:00 PM. Licensee, and son are the only adults residing in the home. Entrance Checklist was provided to Licensee. LPA reviewed a current Child Care Facility Roster and Fire/Disaster drill log during today's inspection. The last fire/disaster drill was completed on 1/5/2026. Licensee has liability insurance for the day care that expires on 4/1/2026. Licensee & assistant have a current CPR and First Aid certifications on file. Licensee & assistant have the required vaccines and Mandated Reporter Training for Child Care Workers Certificate. LPA reviewed children's files and the files were complete with the required forms. LPA also reviewed staff files and the files were complete with the required forms . LPA toured the indoor and outdoor areas of the home during today's inspection. Licensee has a working telephone in the home. The home is clean, orderly, (including heating/fans/ventilation), and safe for the day care children. There are safe & age-appropriate toys, play equipment, and materials for the children in the home. The off-limit areas inside the home are: master bedroom & bathroom, and bedroom. Off limit outdoors: right side of home is restricted including shed, laundry room, and garage. LPA observed a fully charged 3A40BC fire extinguisher in kitchen area working smoke/carbon monoxide detector, and no bodies of water. All detergents, cleaning compounds, medications, and other similar items are inaccessible to children. Licensee states that she does not administer any medications to the day care children at this time. Licensee states there is no weapons/firearms in the home. Licensee states that she provides breakfast, snack (AM & PM) lunch to the day care children. Licensee states that she understands that any food brought from home needs to be labeled with each child's name and properly stored. Licensee provides water to children in cups indoors and outdoors. Licensee has a first aid kit in the home. Licensee states that nobody smokes and she understands that smoking is prohibited in the home. Incidental Medical Services (IMS) policy was discussed. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm Supervision of children was discussed with the Licensee and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee also understands that she must be home at least 80% of the time FCCH is open. Licensee states that a child will be isolated in the eating area if necessary, due to illness or communicable disease. Licensee states she does not transport day care children. Licensee understands that children shall not be left unattended in parked vehicles and that car seats shall only be used for transportation and shall not be used for sleeping. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with the Licensee and discussed the Child Care Licensing Safe Sleep webpage a https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. On this date, 1/6/2026, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. During the exit interview, the Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.
