What the inspector wrote

Licensing Program Analysts (LPAs) Jovani Dillon and Joe Macias conducted an unannounced Case Management Inspection. The LPAs were greeted and granted entrance by the Director Peggy Focha. The purpose of today’s inspection is to ensure the home is in compliance with Title 22 California Code of Regulations. The San Jose Regional Office has made several attempts to contact the facility. The phone number provided goes directly to voicemail and the voicemail box is full. The Director provided an updated phone number (831)234-9405, as well as an email address. The operational hours are M, W, F 8am - 4pm, and T, Th 8am - 6pm. The Annual fees are current. While touring the facility the LPAs observed the center to be out of ratio. The Director explained that she was aware that she is out of compliance. There were 6 children and 1 staff member present. LPA Dillon reminded the Director of the importance of remaining in ratio compliance. Reviewing with the Director that there shall be 1 fully qualified teacher to 4 infants. The center is licensed to provide care for infants ages 7 months to thirty months. With a component for up to ten toddlers. LPA Dillon explained the importance of ensuring additional staff (substitute)who are cleared and associated to the facility license are made available. LPAs observed a baby bouncer present in the facility during today's inspection. LPA Dillon explained that bouncers, saucers, and jumpers are prohibited in a licensed child care center. The Director agreed to remove the bouncer during today's inspection. Type A deficiencies cited, and appeal rights issued. Exit interview conducted and report was reviewed with the Director Peggy Focha A notice of site visit was given and must remain posted for 30 days. Child Care Parent Notification Requirements and Acknowledgement of Receipt of Licensing Reports (LIC9224) was also explained and provided to Licensee during today’s Inspection.

Explaining that additional staff was not available. There were a total of 6 children and 1 staff member present today. This poses an immediate risk to the health, safety, and personal rights of the children in care.

    Infant Care Center Fixtures, Furniture, Equipment and Supplies:Furniture shall be maintained in good repair and safe condition. The facility was found to be out of compliance by evidence of a bouncer present in the facility during today's inspection. The Director was reminded that baby bouncers, walkers, and jumpers are prohibited in a license child care center.This poses an immediate risk to the health, safety, and personal rights of the children in care.
