CHILD CARE CENTER DIRECTOR QUALIFICATIONS AND DUTIES

101215.1 Child Care Center Directors Qualifications and Duties (f) When the child care center director is absent from the center, arrangements shall be made for a fully qualified teacher... to act as substitute. This substitute child care center director shall be aware of center operations, including total enrollment; shall be trained in program operation; and shall be designated as an authorized person to correct operational deficiencies that constitute immediate threats to children's health and safety.This requirement was not met as evidenced by: When the Site Director left the facility at 4:00PM on the day of the incident, she did not designate a fully qualified teacher to act as a substitute director, which poses a potential risk to the health, safety, and personal rights of children in care.

CRIMINAL RECORD CLEARANCE

101170 Criminal Record Clearance (e) All individuals subject to a criminal record review... shall prior to working, residing or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance...This requirement was not met as evidenced by: During winter camp hosted at Vine Hill, staff from Brook Knoll were assisting without fingerprint clearance transfer between the facilities, which poses a potential risk to the health, safety, and personal rights of children in care.

REPORTING REQUIREMENTS

101212 Reporting Requirements (d) Upon the occurrence... a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours.. a written report.. shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by:The facility was notified about a child being left outside unattended on 1/3/2024 and the initial report to the Department was made on 1/8/2024, which poses a potential risk to the health, safety, and personal rights of children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Reponsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement was not met as evidenced by:On 12/21/2023 during a winter break camp held at the facility, a child was left outside on the playground without supervision, which poses an immediate risk to the health, safety, and personal rights of children in care.

Based on interview and record review, the licensee did not comply with the section cited above as it has been more than 180 days since the facility received a license, which poses a potential health, safety or personal rights risk to persons in care.

HEALTH-RELATED SERVICES

Based on observation, interview, and record review, the licensee did not comply with the section cited above as three out of three medications stored at the facility were expired, which poses a potential health, safety or personal rights risk to persons in care.

101516.5 Teacher-Child Ratio (b) There shall be a staffing ratio of one teacher and one aide present to every 28 children in attendance.This requirement was not met as evidenced by: The Site Director did not ensure that staff:child ratio requirements were met, as staff reported supervising more than 14 children, which poses an immediate risk to the health, safety, and personal rights of children in care.

101170.1 Criminal Record Exemptions (b)...the licensee must return the confirmation of removal form that is sent by the Department, within five (5) days of the date of the form, that confirms under penalty of perjury that the individual has been removed from the facility. This requirement was not met as evidenced by:The Site Director did not submit confirmation of removal within five (5) days, which poses a potential risk to the health, safety, and personal rights of children in care.

PERSONNEL REQUIREMENTS

101216 Personnel Requirements (g) All personnel... shall be in good health and shall be physically and mentally capable of performing assigned tasks. (1)... good physical health shall be verified by a health screening, including a test for tuberculosis, performed by... a physician not more than one year prior to or seven days after employment or licensure. This requirement was not met as evidenced by:Four out of seven personnel files reviewed did not have proof physicians report, which poses a potential risk to the health, safety, and personal rights of children in care.

ARTICLE 1. General Provisions and Definitions

1596.7995(a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.This requirement was not met as evidenced by: The Site Director did not provide proof of required immunizations for two out of seven personnel files reviewed, which poses a potential risk to the health, safety, and personal rights of children in care.

ARTICLE 2. Administration of Child Day Care Licensing

1596.841 Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request. This requirement was not met as evidenced by:The facility did not have a children's roster, which poses a potential risk to the health, safety, and personal rights of children in care.

101170 Criminal Record Clearance (d) All individuals subject to criminal record review shall, be fingerprinted and sign a Criminal Record Statement (LIC 508 [Rev. 1/03]) under penalty of perjury.This requirement was not met as evidenced by: The Site Director did not obtain fingerprint clearances for one staff member, which poses an immediate risk to the health, safety, and personal rights of children in care.

SIGN IN AND SIGN OUT

101229.1 Sign In and Sign Out (b) The person who brings the child to, and removes the child from, the center shall sign the child in/out.This requirement was not met as evidenced by: The Site Director did not ensure that children attending the facility were signed in upon arrival which poses a potential risk to the health, safety, and personal rights of children in care.

101170.1 Criminal Record Exemptions (q) If a request for an exemption has been denied, the individual shall be excluded for a period of two years... (2) An exclusion order based solely upon a denied exemption shall remain in effect and the individual shall not be employed in or present in a licensed facility... unless either a petition or an exemption is granted. This requirement was not met as evidenced by:The Site Director continued to employ staff member after removal date of 10/13/2022, which poses an immediate risk to the health, safety, and personal rights of children in care.

PERSONNEL RECORDS

101217 Personnel Records (a) The licensee shall ensure that personnel records are maintained on the licensee, administrator, and each employee. Each personnel record shall contain the following information:This requirement was not met as evidenced by: The licensee failed to maintain personnel records as many required documents were missing which poses a potential threat to the health, safety, and personal rights of children in care.

REPORTING REQUIREMENTS

101212 Reporting Requirements (b) The name of the child care center director... shall be reported to the Department within 10 days of a change of child care center director or designee.This requirement was not met as evidenced by: Site Director present at the facilty, Stephanie Stellman, was associated to the facility on 1/8/2023, and the department was not notified of changes which poses a potential threat to the health, safety, and personal rights of children in care.
