What the inspector wrote
Licensing Program Analysts (LPAs), Cortney Nelson and Marilou Monico, met with Site Director, Madelynn Van Den Heuvel, and Teacher, Joy Parker, and explained the purpose of today's visit- conduct pre-licensing facility measurements and inspection to provide the facility a provisional license. Joy will be the interim Site Director for Madelynn while she is out on maternity leave April - July 2023. LPA's were admitted into the facility by Madelynn and toured both inside and outside during todays visit.
The facility is being issued a provisional license and must submit a fully completed child care center license application within 90 days. The initial application has been received at the San Jose Regional Office and request for revisions was mailed 1/31/2023. A second request for revisions was mailed 3/6/2023. All application components must be submitted within 90 days (by 6/28/2023) and will be subject to further manager review and approval.
LPA's toured inside the facility and observed the following classrooms: Otters & Dolphins for preschoolers and Puffins & Jellyfish for toddlers. There is adequate furniture and equipment for the children that is in good condition and age-appropriate. LPA's advised that bathrooms in the toddler rooms should have partition walls to accord the children safe, healthful, and comfortable accommodations. Site Director, Madelynn, states that the heat in the Otter classroom is currently not working due to the furnace needing replacement and LPA's reminded that the minimum room temperature is 68 degrees for child care centers. During today's visit, LPA's noted that the temperature in the room was 64 degrees and observed a plug in heater, located inaccessible to children, warming the room.
The toddler classrooms have 10 tables, 15 chairs, 36 cubbies, 11 hooks, 12 nap mats, 12 nap cots, 5 sinks, and 4 toilets. The preschool classrooms have 26 tables, 59 chairs, 105 cubbies, 19 nap cots, 11 nap mats, 6 sinks, and 5 toilets. LPA's advised Madelynn that during nap time, cots/mats should be arranged so that no exit is blocked, as they were observed to be blocking the exit in the toddler rooms.

LPA's toured outdoor areas of the facility and observed it is fenced in, with shade provided by building overhang and large trees. Building permits for the "Octopus/Outdoor" classroom were being completed, however the facility has decided to cease the permitting process. Outdoor measurements completed today did not include the "Octopus/Outdoor" classroom area as the facility has indicated that they will be demolishing the constructed buildings that require permitting in that area. LPA's advised that because the building demolition will include electricity and plumbing, demolition permits must be obtained from the Scott's Valley Building Department. A follow-up inspection will be conducted once demolition has been completed for the outdoor area. Madelynn states that the "Octopus/Outdoor" classroom area will be reallocated to a toddler yard and the outdoor space measured today will be a preschool yard.
LPA's advised that the barricade between infant component and toddler yard will need proper fencing, at least four feet high. The playground has sufficient resilient materials (tanbark) and is age-appropriate for preschoolers/toddlers. No bodies of water were observed during today's inspection.

LPA's advised submitting a waiver for shared use of the outside area between the preschool and toddler component. The facility may submit a staggered schedule for playground use between the components to demonstrate shared use of the outdoor space without commingling. LPA's advised an additional waiver should be submitted for the facility to be licensed for 90 children, even though the outdoor space measures for 66 children.
Exit interview conducted and report was reviewed with Site Director, Madelynn Van Den Heuvel, and Teacher, Joy Parker.
The facility will be under further review and LPA's advised a license will be issued pending manager review and completion of the following corrections within 90 days (6/28/2023):
-Submission of complete child care center application with designated revisions from the Department to meet Title 22 compliance
-Two (2) outdoor space waivers submitted for capacity limitations and preschool/toddler staggered outdoor play schedule
-Bathroom partition walls added to the toddler rooms (Jellyfish/Puffins) to accord the children safe, healthful, and comfortable accommodations
-Replaced furnace in the Otter Classroom to ensure proper temperature (min. 68 to max. 85 degrees) for child care center compliance
-Submission of Qualifications for Site Director, Madelynn Van Den Heuvel, as all centers must have a qualified director. (Proof/letter of prior teaching experience, personnel report (LIC500) separated by components, & health screening)
-Updated facility sketch (LIC999) clearly indicating updated use for the outside play areas, office space, and labeling of the classrooms with the center naming convention and age of children in the room. (ex: Classroom #1- Otters/Preschool)
-All employees fingerprint clearances must be transferred to the facility's new license number (#444417076)
-"Octopus/Outdoor" classroom area not to be used by children until follow-up inspection completed for outdoor measurements and review of compliance with Scotts Valley Building Demolition Permitting requirements.
