What the inspector wrote
On 02/08/2024 Licensing Program Analyst (LPA) Janette Cruz and Licensing Program Manager (LPM) Deborah Lowe met with Applicant representatives, Olesya Kalinowska & Gloria Aguirre . The purpose of the visit was an announced pre-licensing inspection at the facility to ensure that health, safety and personal rights as required by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were no children present during this inspection. The facility is located within the premises of Aptos Community United Methodist Church. This is an application for 36 children, ages 2 to 6 years old. The child care center will operate Monday \342\200\223 Friday 7:00 a.m. \342\200\223 5:30 p.m. The fire clearance was approved on 01/30/2024.
LPA and LPM toured and measured the on-limits areas and classrooms located at the facility. The facility has an open floor plan with the ability to use accordion doors to section main room to four individual spaces, Room 1 is a separate room near office intended to use for children ages two years old.

The Indoor total measurements contain a total of 2444.74 square feet, which will accommodate Applicant\342\200\231s request for 36 children.

Indoor/Children\342\200\231s Area:
The facility was observed to be clean, safe, sanitary and in good repair to ensure the safety and well-being of children, employees and visitors. A comfortable temperature for children shall be maintained at all times. Furniture and equipment were observed to be maintained in good condition, free of sharp, loose or pointed parts. There are
36 chairs, 6 tables, 18 cubbies, 2 urinals, 8 toilets, and 6 sinks for the preschool program. There are age-appropriate fixture and equipment available for children during today\342\200\231s inspection. The Applicant shall ensure that each child has an individual permanent or portable storage space for his/her clothing, personal belongings and/or bedding. LPA and LPM observed that cubbies good for 18 children is located outside of the classroom, as per Applicant cubbies will be added to accommodate total number of children capacity. A sectioned off storage area located right side of kitchen is off-limits to children and was made off limits by using sliding accordion doors. LPA and LPM also discussed that minimum temperature in the room, which is 68 degrees Fahrenheit. There is fully charged fire extinguisher, smoke detector, and carbon monoxide detector.
Drinking water from a non-contaminating fixture or container shall be readily available both indoors and in the outdoor activity area. LPA advised per Health and Safety Code 1597.16(a)(1) Lead Testing and PIN-21-21-CCP
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018
, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test.
Per Written Directive 100700(c)(1) Written Directives for Lead Testing (1) For a license issued on or after July 1, 2022, initial testing results shall be received and posted within 180 days of licensure.
The Applicant shall take measures to keep the center free of flies, other insects, and rodents. All containers used for storage of solid wastes, including moveable bins, shall have a tight fitting cover that is kept on. Applicant stated that facility will have professional pest control service. LPA and LPM observed no fireplace or open face heaters.
Disinfectants and cleaning solutions are located in hallway storage closet inaccessible to children, facility will be adding a child proof lock on storage closet. Storage areas for poisons shall be locked. LPA advised that Applicant maintains the following first-aid supplies in a location accessible to staff but inaccessible to children: current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution. First aid supplies were not available during time of inspection.
The isolation area shall be located in the facility office to afford easy supervision of children by center staff. The isolation area shall be equipped with a mat, cot, couch or bed for each ill child. The isolation area shall not be located in the kitchen area or the general-use toilet area.
Applicant was reminded that all child care centers shall have working telephone service on the premises.
The Applicant shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.
LPA advised that smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).
Facility currently has seven mats for napping, Applicant provided proof of additional mats purchased for 12 children.
All toilets, handwashing and bathing facilities shall be maintained in safe and sanitary operating condition.
LPA observed hot and cold water available Applicant was advised hot water temperature maintained of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C), notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water. Staff bathroom is available that can be used as isolation area for a sick child.
Outdoor:
LPA and LPM observed adequate shaded rest area for the children. Outdoor area is fenced and free of hazards. Playground behind Room 1 is off limits to children due to equipment observed as not age appropriate.
Health Related Services:
Medications shall be kept in a safe place inaccessible to children. A refrigerator shall be used to store any medication that requires refrigeration.
Food Service:
All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children.
Meals and snacks will be prepared and provided by the facility. Drinking water is provided through water service, facility is awaiting arrival of water dispenser.
All kitchen, food-preparation and storage areas was observed to be clean and free of litter and rubbish; and measures shall be taken to keep all such areas free of rodents and other vermin.
The following items were discussed:
Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

, as an additional resource. LPA also informed Applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at:

, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reviewed with Applicant the LIC 311A, Records to Be Maintained At The Facility, for child\342\200\231s records, personnel records, administrative records, and documents to be posted.
Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California..
Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

An exit interview was conducted with the above items discussed and a copy of appeal rights and this report was provided to the Applicant Representatives: Olesya Kalinowska and Gloria Aguirre Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
