What the inspector wrote

The following violation of the California Code of Regulations, Title 22; Division 12, was observed for the Lack of Supervision: see LIC 9099D. Reports citing Type A violations are to be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file. Notice of Site Visit shall be posted for 30 days from today’s visit. It was also alleged that the Facility failed to report unusual incidents of sexualized behaviors between children in care. The IB investigation found that on at least four occasions, between March – May 2022 Child Care Center (CCC) staff observed or were made aware that children had engaged in sexualized behaviors while being supervised at the center. These incidents were not reported to the Department, nor to Child Protective Services (CPS). Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. The Notice of Site Visit must be posted for 30 days.

  • REPORTING REQUIREMENTS

    Reporting Requirements: Each licensee or applicant shall furnish to the Department reports as required by the Department including, but not limited to, the following: Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. Shall be reported within 24 hours and in writing within 7 days. This requirement is not met as evidenced by the director admission and lack of reports for at least 5 reportable incidents. Which poses/posed a potential Health and Safety risk to children in care.

  • PERSONAL RIGHTS

    Personal Rights, The licensee shall ensure that each child is accorded the following personal rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by multiple incidents of sexualized behaviors between children. Based on interviews and written documentation. Which poses an immediate Health and Safety risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher. This requirement is not met as evidenced by multiple incidents of sexualized behaviors between children without staff observation or intervention. Based on interviews and written documentation. Which poses an immediate Health and Safety risk to children in care.
