What the inspector wrote

A case management inspection was conducted by Licensing Program Analyst (LPA), E. Friese and N. Cunningham in response to an unusual incident that occurred on 1/29/24. The director reported this incident to Community Care Licensing and Child and Family Services. The director reported Staff 1 informed her that three preschool children (Child #1 - Child 3 - Confidential Names LIC811) were unsupervised on the playground for an unknown amount of time. While the children were unsupervised, Child 1 informed staff that another child, (Child 2) kissed their bottom and their front. During today's inspection, LPA interviewed Child 1-3 and Staff 1-2. Child 3 stated to LPA that Child 1 told them to pull down their pants and Child 2 kissed their bottom. The director and staff do not believe Child 1 pulled their pants down; however, staff acknowledged the three children were unsupervised for an unknown amount of time. The director reported the three children provided inconsistent statements of the incident. The director stated two teachers (Staff 1 and Staff 2) were supervising 17 children on the playground when the incident occurred. The director acknowledged that the shed and tree stump create a blind spot and plans to discuss options to eliminate the blind spot with the licensee. The parents/guardians of the involved children were notified of the incident. It was determined on 1/30/24 children were not directly supervised as required as staff were alerted of the incident by Child 1. A civil penalty shall be assessed due to two lack of supervision citations within a twelve *Continued on 809C month period. The parents of the three involved children were immediately notified of the incident. This report was reviewed and discussed with Center Director, Lisa O’Neal. All licensing reports are public information and must be made available upon request for at least three years. Notice of Site Visit shall be posted for 30 days from today's inspection. The following violation of the California Code of Regulations, Title 22; Division 12, was observed: see LIC 809D. Appeal Rights (LIC 9058) were provided. Reports citing Type A violations, an immediate Health and Safety risk to children in care, are to be provided to parents/guardians of children currently in care of the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians will be required to sign Acknowledgement of Receipt of Licensing Reports (LIC 9224)

    The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews, staff failed to provide direct supervision of three children on 1/29/24. This poses an immediate health, safety or personal rights risk to persons in care.
