What the inspector wrote

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Also, LPA Cunningham informed the licensee to provide a copy of this licensing report dated 11/1/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

    (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A) Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. Based on the licensee's statement and LPA's observation, a portion (approximately 20 feet) of the pool fencing is not five feet high This was an immediate health and safety risk to children in care.

    (b) The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. Based on LPA's observation, the home was cluttered, stains on the couch, dirth dishes on the counter, and a stale odor throughout the home. The outdoor area was dusty and unorganized. This is an immediate health and safety risk to children in care.
