What the inspector wrote

Licensing Program Analyst (LPA) Glenn Ouye returned to the facility to complete interviews regarding a self reported incident where a teacher used inappropriate language and also handled children in an inappropriately rough manner. LPA Ouye interviewed two staff who witnesses the event which occurred on June 26, 2024 just after the facility conducted a fire drill. The children and staff were returning to the classroom when staff S1 who was one of the staff bringing the children back into the classes told two children to hold hands while walking back into the class. The children may not have understood or did not hear the teacher and did not hold hands. S1 then raised her voice while instructing the children to hold hands and grabbed the children's arms force them to hold hands. This was witnessed by staff S2 and S3. Staff 2 also witnessed S1 swearing in front of the children on multiple occasions. Staff S2 explained to S1 that swearing in front of children is inappropriate and should never occur in the presence of children, however S1 did swear on more than once occasion in front of the children. The action of the staff S1 swearing in front of children and grabbing the child in a rough manner is a violation of the child's personal rights. The facility management planned to meet with S1 to address the violations of internal policy and procedures and to provide retraining for S1, however S1 resigned on June 27, 2024. The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided.

The requirement has not been met as evidenced through interviews with staff S2 & S3 who witnessed S1 speaking and handling children in an inappropriate manner that volated their personal right. This poses a immediate personal rights violation to the children in care.
