What the inspector wrote

A Required inspection was made to the facility by Licensing Program Analyst (LPA), M. Augustin. A review of staff records on 08/17/2022 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. There are currently two adults living in the home. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. During today\342\200\231s inspection the home and grounds were toured. Licensee (LS) and one staff (S1) were supervising five child and the facility was operating within the licensed capacity and ratio requirements. No children were observed left in any parked vehicle. The facility\342\200\231s operating hours are 6:00am - 5:00pm, Mon\342\200\223Sun. The floor plan submitted by the licensee was reviewed and verified. The off-limits areas of the home are four bedrooms and two bathrooms on the upper level and were made inaccessible by a child safety gate. There is a working telephone in the home. There is a functional smoke and carbon monoxide detectors; and a fully charged fire extinguisher rated at least 2A10BC. Poison(s) are locked in the garage. There were no firearm(s) or other dangerous weapons stored on the premise. Two staff (S1 & LS) records were at 10:46am which contained current AB 1207 Mandated Reporter Training certificates, required Immunization Records, and Criminal Record Statement (LIC 508). One child\342\200\231s (C1) records was reviewed at 11:18am which revealed the LIC 282 and Consent for Emergency Medical Treatment (LIC 627) were not signed by C1\342\200\231s parent/authorized representative and Immunization Record (IR) was not current. (Continue to LIC 809-C) During today\342\200\231s inspection, S1 stated there were zero children under 24 months old enrolled in care. The facility conducted an emergency disaster drill within the past six months and the last drill was documented on 04/14/22. The facility roster of the children in care was reviewed and appeared to be complete. S1\342\200\231s EMSA approved pediatric CPR/First Aid certification expire on 11/2023. The backyard was fully fenced. There were no pools or other bodies of water observed in the yard. The facility is not providing Incidental Medical Services (IMS) to children in care. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. A notice of site visit was given and must remain posted for 30 days . Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the facility representative. The following violation(s) of the California Code of Regulations, Title 22; Division 12 was cited during today\342\200\231s visit. Appeal Rights were provided.
