Inspector’s narrative

What the inspector wrote

An annual random inspection was made to the facility by Licensing Program Analysts (LPAs), Amy Strother and James Clark. LPAs met with Licensee, Dolores Benson (L1). L1 was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. During the inspection the home was toured inside and outside. The licensee and three assistants (S1-S3) were supervising 8 children (2 infants and 6 preschool age children) and operating within the licensed capacity and ratio requirements. L1 provided a current roster of children in care as required. LPA verified that the children present were listed on the roster. The facility\342\200\231s operating hours are Monday \342\200\223 Friday, 7:30AM - 5:30PM. The floor plan submitted by the licensee was reviewed and verified. The off-limits areas of the home are the entire second floor, kitchen, and the garage, and were made inaccessible by children's safety gates and a door locking mechanism. The bottom of the staircase near the front entry door was barricaded with a child safety gate. The fireplace in the nap room was screened with a child safety gate. The home appears to be clean and orderly and was at a comfortable indoor temperature. There were safe toys and equipment available for children. There is a working telephone in the home. L1\342\200\231s pediatric CPR and First Aid certifications were reviewed and expire on 11/2026. Items which could pose a danger to children (such as detergents, cleaning compounds, medications, etc.) were observed to be stored out of the reach of children. Licensee stated there are no poisons on the premises and none were observed. The Licensee stated there were no firearm(s) or other dangerous weapons stored on site. Continue on LIC809-C PAGE 2 LPAs observed a working smoke detector, carbon monoxide detector and a fire extinguisher that appeared to be charged, rated at least 2A10BC, in the home. The licensee has conducted an emergency drill within the past six months; last drill was documented on 06/25/25. The children use the ully fenced backyard as the outdoor play area. There were no swimming pools or other bodies of water observed on the property. Five children's records (C1-C5) were reviewed, C5's file did not contain all required immunizations. Based on interview with L1, C5 is due for three additional vaccinations that they have not yet received. Based on file review and interview with L1, L1 does not have current infant safe sleep logs for infants C3 and C5, both present during today's inspection. L1 stated that she thought they were no longer needed after 18 months of age. Personnel files were reviewed and contained required records. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for and removing any recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Continue on LIC809-C PAGE 3 Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPAs completed the RSO profile in FAS. The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Dolores Benson.
