What the inspector wrote

Licensing Program Analyst (LPA), Melchisedeck Augustin made an unannounced Plan of Correction (POC) visit and met with the Center Director, Linda Reid (CD), for the purpose of following up on two type B deficiencies that were cited as a result of a substantiated complaint allegations. The violations involved violation of children's personal rights pertaining to staff speaking inappropriately to and yelled at children in care. The Department previously referred the facility to the Technical Support Program (TSP) which is a non-enforcement program that consists of on-site consultation visits, and CD voluntarily agreed to participate in TSP to receive training on children's personal rights. Furthermore, CD was provided with a four page article from, ChallengingBehavior.org" and a one page article on, "Creating Teaching Tools for Young Children with Challenging Behavior", and CD agreed to review provided resources and obtain personal rights training from an outside agency for all staff by 08/02/23. Upon LPA's arrival, there were initially six children in care with CD and a volunteer (V1). V1 left with their own child and there were five children in care with CD. At 12:08pm, LPA observed three children were left unattended on the playground, while CD was inside the classroom. It is noted that the children did not appear to be in distress and there was no health and safety concerns. CD confirmed the facility had a current staffing shortage and CD was having difficulty supervising the children by herself, but CD noted that another staff would arrive to provide support in the afternoon; and CD also took some positive steps to attract new staff. CD stated she met with TSP two weeks ago and TSP was due to return to provide additional training. In addition, CD conveyed she was still working on the online training modules on children's personal rights, and completed three out of six modules. According to CD, she was having technical issues with the website and could not provide certificates of completion, but CD intends to furnish a copies of her certificates to the Department, and CD requested for the Department to allow her an extension on her POC. Based on CD's statement of having completed three out of six online training modules, the Department is providing CD an additional two weeks to complete the training, and the new POC due date will be 08/29/23. (Continue to LIC 808-C) LPA consulted on the requirements of California Code of Regulations (CCR) 101229(a)(1), and CD understood that no child(ren) shall be left without the supervision of a teacher at any time. CD was interacting calmly with the children and LPA did not see any violation of children's personal rights. Exit interview conducted and report was reviewed with the Center Director, Linda Reid. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. There were no violation(s) of the California Code of Regulations, Title 22; Division 12, Chapter 1, Article 06 observed during today\342\200\231s visit. See LIC 809-D.
