What the inspector wrote

Some guardians reported they had seen the highchairs in use for feedings. Other guardians reported the highchairs were used during circle times and activity times, how ever they observed other children sitting on the floor during circle time and weren’t sure for how long or why some children were placed in the highchair. Some guardians reported highchairs were used as a form of discipline if the child wasn’t listening after being sent to the red chair, then they would be placed in the highchair. Children interviews corroborated time out is on the red chair, and some children reported if they aren’t listening then they get placed in then highchair. LPA received documentation of children being sent to time out and placed in the highchair. There was one written document that described a child was sent to the red chair, wouldn’t sit still so was placed in the highchair where the child peed on themselves. LPA also reviewed evidence of staff recording children having a ‘fit’ while being told to go time out. The recording shows a child crying, flaying on the ground and other children walking by observing the child and staff interaction, while other children are in time out as well. Based on interviews conducted and records reviewed the preponderance of evidence standard has been met and the above allegation is found to be substantiated. The California Code of Regulations, Title 22, Division 12 & Chapter 1, section 101223(a)(3) is being cited on attached LIC 9099D . This report was reviewed with the assistant center director and an exit interview was conducted. A copy was provided and Notice of Site Visit shall be posted for 30 days. Appeal Rights were provided. Interviews with staff revealed, sometimes guardians would pick up children during nap time, and if the child is in a diaper or pull up, then there is a possibility the child has a dirty diaper since the staff would change the child when they woke up. One staff reported they would ask guardians if they wanted the child’s dirty diaper changed at pick up time, but the guardian declined. Staff also reported some children would not communicate when they had soiled diapers so its possible due to children not communicating those children had soiled diapers until a staff noticed. Some staff reported they would document on the Bright Wheel App when they changed children’s diapers, but it is possible not all staff were documenting the diaper changes. One staff reported, its possible a child could have been left in a dirty diaper if it was the end of the day and there was only one or two staff working. All children interviewed, reported they potty in the bathroom. Some children reported they walk themselves to the bathroom, others reported the teachers take them to the bathroom, and they wash their hands afterwards. Most guardians interviewed reported their children are potty trained. Some guardians reported their children would wear a pull up or diaper at nap time. and if there is an accident they are notified via the Bright Wheel App. Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated. This report was reviewed and discussed with assistant center director, she was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.
