What the inspector wrote

CD described that one day in August 2023, S2 was alone in Preschool 1A classroom with 11 or 12 children, C1 had to use the bathroom, S2 stood by bathroom door to ensure supervision of the classroom including C1 in the bathroom; and S2 verbally guided C1 on how to wipe after toileting. CD felt staff had enough experience to determine when a child’s diaper or undergarment needed to be changed; and planned to conduct an activity with balloons to show children how to wipe. Statements provided by S1-S4 and A1 did not report concerns related to staff refusing or intentionally not meeting child(ren)’s toilet needs, however; some staff felt there were misinformed, and there was mis-communication among staff and facility management which resulted in misunderstanding on staff’s permissibility to wipe a child in the bathroom. S1 stated one and half week before her interview, S2 did not enter the bathroom to wipe C1 because S2 did not know if she was allowed to wipe a child, while A1 reported another child was left in a soiled diaper in June or July 2023, due to mis-communication between staff. Statements provided by P2-P7 did not report recent or prior incidents and parents stated when they dropped off, they noticed staff tending to the children’s needs, their child(ren) never disclosed any concerns to them; and they did not have any concerns related to toileting issues. The facility was misinformed but since then CD confirmed she understood it was the staff’s responsibility to ensure the needs of the children, including toileting, were met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that staff intentionally left C1 in soiled undergarment, therefore the allegation is unsubstantiated. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. There was no violation of the California Code of Regulations, Title 22; Division 12, cited during today's visit. Appeal Rights were provided.
