What the inspector wrote

Licensing Program Analyst (LPA) Elpidia Hernandez Torres arrived to the center on 12/10/24 to conduct a case management visit regarding a self reported incident that occurred on 11/12/24. According to report received, on 11/13/24, Child (C1) was left alone with out staff supervision in the ‘middle yard’ for approximately 27 minutes from 04:53PM- 05:20PM. Child was discovered when guardian arrived to the center to pick up them up. LPA interviewed Center Director and three staff between 09:50AM-12:57PM. Center director reported she had conducted an internal investigation and found that C1 was left in the middle playground during the afternoon recess after the classrooms lined up and came back into their classrooms, when the staff (S4) from C1’s classroom failed to communicate to other staff they were leaving for the day and the child was not on any of the other staff’s roster. Staff interviews corroborated, the preschool classrooms will merge during the afternoon recess when the lead teachers of each classroom communicates how many children they have. Teachers will acknowledge the merge by combining either; classroom rosters of children present through their app or by taking the physical clip board and adding the children to their iPad roster to than conduct name to face checks at each threshold. Since C1 was not added to any staff’s roster when S4 left, none of the staff in the playground knew to look for C1, or ensure C1 was in their line. Guardian then arrived to pick up C1, who was not found in any of the classrooms when guardian walked to the playground with Assistant director and found C1 standing by the gate alone, with no staff outside with them. Continued on 809-C Center director reported since that incident, S4 no longer works at the center, and the center director has changed the schedule for out door play time as well as the play grounds assigned to each classroom. There are also set alarms to remind center director to go physically observe the name to face checks being conducted at every threshold, and the center coordinator goes outside after each recess to conduct a sweep of the playground and ensure there are no children left on the playgrounds. An immediate $500 civil penalty is being assessed for absence of supervision. Exit interview conducted and report was reviewed with the Center Director, Biane Isbeih. The following Health and Safety code 1596.99(c)(3), is being cited on the attached LIC 809D. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in a $100 civil penalty. Appeal Rights were provided. LPA Elpidia Hernandez Torres informed facility representative that this report dated 12/10/24 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA informed the facility representative to provide a copy of this licensing report dated 12/10/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification
