What the inspector wrote

During the investigation, the LPA interviewed Staff\342\200\257S2 about the allegations. Staff S2 denied that she ever handled children roughly or spoke to them inappropriately. Staff S2 acknowledged helping children during mealtime on the day of the alleged incidents and playfully taking items from children and interacting with them but insisted that she did not do anything improper or rough. She explained that the facility environment during lunch time and transitions between activities is often loud and chaotic, which sometimes requires her to raise her voice so the children can hear her. Staff S2 stated that that some of her actions may have been taken out of context. Staff S2 also said that there are occasions when she must use a stern tone to manage behavior, but she firmly denied ever speaking to the children in a threatening or inappropriate manner or roughly handling any child. Throughout the course of the investigation, the LPA conducted observations and interviewed children, staff S1-S3, and other individuals familiar with the facility. The information obtained through these interviews did not yield any corroborating evidence to support the allegations. Furthermore, during the LPA\342\200\231s visits to the facility on July 17 and the date of this report, no observations were made indicating any violations of children\342\200\231s personal rights. The children in care appeared to be treated with dignity in their interactions with staff and others and were provided with safe, healthful, and comfortable accommodations, furnishings, and equipment. Based on available information, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility\342\200\231s licensee, Gwendolen Foursha. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
