Licensing Program Analyst (LPA), Leticia Rosales made an unannounced Case Management (CM) and met with Licensee (LS), Diana Cuevas, for the purpose of reviewing children’s records and verifying the files contained signed copies of Addendum to Notification of Parent’s Rights (LIC 995B). On 08/14/23, the Department’s Legal Division issued a Decision and Order that ordered exclusion/removal of an adult, which became effective 8/24/23. During the visit, there were seven children in the care of LS and staff 1 (S1). LPA reviewed fourteen children’s records, which revealed that the records did not contained signed copies of LIC 995B, as required by California Code of Regulations (CCR) 102419(h). According to CCR 102419(h), the licensee shall provide a copy of the Department Issued Addendum to Notification of Parent's Rights (Regarding Removal/Exclusion) (LIC 995B Rev. 05/03) sent by the Department, that is still in effect, to one parent or authorized representative of every child when the parent or authorized representative arranges for child care services or on the first day the child receives care, whichever is first. LPA provided LS with a copies of LIC 995B and Decision and Order, and consulted with LS about the requirements of providing parents with the LIC 995B. Title 22 deficiency is being cited on the attached LIC 809D. Appeal rights were provided. Exit interview conducted, and report was reviewed with Licensee, Diana Cuevas. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
