What the inspector wrote

An announced case management visit was conducted at the facility by Licensing Program Analyst (LPA) Y. Yang. During the visit, while addressing an unrelated matter involving staff member S1, it was discovered that S1, who has been employed at the facility since 10/11/2025 does not have the required California fingerprint clearance on file or a criminal record exemption. During today’s visit, the LPA met with Center Director Mario Zettler to discuss the issue and obtain additional information. The director stated that staff member S1 is currently employed as a lead teacher in a preschool classroom. He reported that he was unaware S1 did not have a valid criminal record clearance, as S1 was hired prior to his appointment as director. On 04/10/26 at 2:30 PM, the LPA reviewed the facility’s personnel roster and observed that S1 was not listed. A search conducted in Guardian confirmed that S1 does not have an eligible criminal record clearance on file. The LPA interviewed S1 during today’s inspection. Based on the interview, S1’s statements, and a review of S1's personnel record, it was determined that S1 completed a Live Scan on 09/09/25. The file contains a copy of the Live Scan receipt and a clearance letter from the California Department of Justice (CA DOJ). However, the Department requires checks from CA DOJ, Child Abuse Central Index clearance (CACI), and the FBI. Records further indicate that on 09/10/25, the Care Provider Management Bureau (CPMB) issued an “Action Required” notice to S1, advising that additional information was needed to complete the background check. The notice instructed S1 to submit the required information by 12/08/25 or the application would be closed. S1's background check was closed due to inactivity. The LPA reminded the director that the facility is responsible for ensuring all staff obtain proper clearance through Guardian prior to working at the center. The director confirmed that the facility has access to Guardian and can view its current staff roster. During today’s visit, Staff S1 was directed to leave the premises. S1 may not return to the facility or resume duties until a valid California criminal record clearance or an approved criminal record exemption has been obtained. The following violations of the California Code of Regulations, Title 22; Division 12, was observed: see LIC 809D. A civil penalty will be assessed. This report was read and reviewed with the center director, Mario Zettler. Notice of site visit shall be posted for 30 days. Appeal rights provided.

Supervision shall include visual observation.This requirement was not met as evidenced by: Based on interviews conducted by the LPA and the center director’s own admission, it was corroborated that on 04/02/26 at approximately 09:30am, child C1 was without supervision of a teacher for approximately two minutes while in the classroom before being reunited with their class. This posed a potential health, safety or personal rights risk to persons in care.
