Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met based on evidenced of records reviewed, photos and interviews. LPA Gibson obtained corroborating interviews, photos, and documentation that revealed staff/witness #5 caused an injury to a daycare child. This posed an immediate risk to the health, safety and or personal rights to children in care.

In addition, a written report... shall be submitted... within seven days.... (1) Events reported shall include... This requirement was not met as evidenced by: Based on records reviewed, interviews and observation, Licensee failed to report incident of staff causing an injury to a child. This poses a potential health, safety, or personal rights risk to persons in care.
