On 06/24/2024, an unannounced Case Management inspection was conducted today by Licensing Program Analyst (LPA), Valerie Mireles. LPA met with Licensee, Traci Butcher. The purpose of today's inspection was to inspect the accessibility of the unfilled above-ground pool in the backyard. Licensee’s above ground pool does not meet the regulation: CCR 102417(g)(5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fishponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use. LPA observed an empty above ground swimming pool the backyard with a gate inaccessible from the backyard with a mesh fence. However, the pool was accessible through three house windows of inaccessible rooms. This does not meet Title 22 regulations. Licensee shall ensure that the windows are made inaccessible prior to filling it with water. Licensee shall inform the Department prior to filling the pool with water so that a final inspection can be conducted to verify that the body of water is made inaccessible according to California Code of Regulations, Title 22, Division 12, Chapter 3, Section 102417(g)(5). Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiency is being cited during today's visit. This report shall be made available to the public upon request.
