On 07/03/2024, Licensing Program Analyst (LPA) Valerie Mireles conducted an unannounced case management inspection, which was initiated by Licensee. LPA met with Licensee Traci Butcher, who accompanied LPA on a tour of the home, inside and outside. There were 13 children present during the inspection and Licensee’s two assistants. The purpose of today's inspection was to inspect an above-ground pool that Licensee has installed on the property. Licensee’s above ground pool does meet the regulation: CCR 102417(g)(5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fishponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. LPA observed the above-ground pool is installed at the west side of the backyard. The above ground pool is made inaccessible by use of a mesh fence, the gate door leading into the pool area swings away from the pool, and is self-closing and self-latching. LPA observed that the above-ground pool currently does not have any water in it and that there are no windows that have direct access to the pool area by use of mesh fence on the west side of the house. The pool has a ladder which is removed and is to continue to be made inaccessible to daycare children. Licensee intends to utilize the pool once it is ready for personal use and will not be used during daycare hours. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiency is being cited. Exit interview conducted with Licensee, Traci Butcher.
