What the inspector wrote

On 06/13/2024, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced Annual Random Inspection and was met by Director Alejandrina Villarreal. This facility operates on a seasonal schedule from April to November, Monday to Friday, from 7:00 a.m. to 4:00 p.m. LPA confirmed the facility has a working telephone service at (209) 862-1605. This facility provides infant formula and or baby food to infants in care. This also facility provides AM/PM snacks and lunch meals to infants/toddlers who eats solid foods. The food is prepared off center premises and delivered to the center. Menus are posted at least one week in advance where parent or authorized representative can view them. LPA toured the facility indoors and outdoors, and a census was taken. All infants are under supervision, including visual supervision, of a teacher at all times. Director understands that there is a ratio of one teacher supervising no more than four infants in attendance. There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible to children. No poisons were observed during the inspection. During the inspection, LPA observed furniture and equipment are in good condition, free of sharp, loose, or pointed parts. All toilets and handwashing facilities are in safe and sanitary operating condition. All infants changing tables are in safe and sanitary operating condition. All floors are clean and safe. All food preparation and storage areas are clean. The facility is free of flies, insects, and rodents. Facility has one or more functioning carbon monoxide detectors that meet the statutory requirements. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. Fire drills are conducted and documented with the date, time and how many infant present, every six months. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. (Continued on LIC809-C). For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Facility enrolled seventeen infants. LPA observed there is one crib or play yard for each infant in care. The cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. Director provided documentation of the physical checks on sleeping infants every fifteen minutes. Staff documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness, and labored breathing. Infants can be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan is completed and in file for each infant up to 12 months of age. Infants up to 12 months of age are placed on their backs for sleeping. Licensee Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Upon notification from the Department, Director will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption. Capacity and limitations as specified on the license are being maintained. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. During record review, all staff have mandated child abuse reporting training. The name of the child care center director or fully qualified teacher(s) designated to act in the director\342\200\231s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. (Continued on LIC809-C). LPA reviewed a sample of infant files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. The Infant files reviewed include Infant Needs and Services Plan and Individual Infant Sleeping Plan. LPA reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training. Staff providing care to infants meet the education requirements. This facility provides Incidental Medical Services \342\200\223 IMS. LPA reviewed storage of \342\200\234medication and equipment/supplies, and reviewed children\342\200\231s, personnel, and administrative records. For IMS information see PIN 22-02-CCP. LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations. LPA discussed Reporting Requirements as outlined in the regulations (Section 101212).
