What the inspector wrote

On May 9, 2022, Licensing Program Analyst (LPA) C Brannon met with director, Susan Savage. During today's case management inspection, LPA toured facility, took a census, reviewed staff and children's files. Upon arriving at the facility at or around 10:30 AM, LPA entered the facility. LPA observed that when entering the facility, the front door will beep, alerting staff that someone entered the building. LPA stood in the lobby. No one was in the office. LPA observed that no one was in the classroom on the left. LPA observed children in the classroom on the right. LPA entered the classroom and heard the door alarm. LPA observed that staff #1 (S1) was sitting at a table with at least four children. S1's back was to at least six children and classroom door. S1 did not turn around. LPA tried to get S1's attention, said good morning to the children who acknowledged LPA. Children, at the table with S1 and those behind S1, tried to inform S1 that LPA was standing there. S1 did not listen. LPA announced her presence in a louder voice to get S1's attention. S1 was not providing the required visual supervision as stated in Title 22, 101229: Responsibility for Providing Care and Supervision. Staff was not providing the required supervision to children, which includes visual observation of children at all times. LPA reviewed this incident with director. This classroom is closer to the front door, which leads to a street. A child could have left their seat and walked out the front door, fencing gate and into the street without staff knowledge. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights. Exit interview conducted and report was reviewed with director, Susan Savage.. This report shall be made available to the public upon request. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

    Responsibility for Providing Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. This requirement was not met as per LPA's observation of S1 sitting in the classroom with S1's back facing to at least 6 preschool children. The front door and classroom door have alarms to alert staff of the doors being opened. Staff did not turn around to see who entered or left classroom. This is a potential personal rights, health and safety risk to children in care.
