What the inspector wrote

Licensing Program Analyst (LPA) Brannon conducted a case management inspection on June 10, 2022. LPA met with facility's new director, Jessica Ramsey. Licensee, Melissa Pershall, has not sent in the required documentation for the new director. During today's inspection, LPA observed the following. 1) There were several parents that were not signing in/out as required. 2) Licensee informed LPA that facility was closed for two days due to several staff having the flu. LPA reviewed emails and did not observed receiving an email from licensee or that licensee called Fresno Community Care Licensing office to report it. During previous inspection on 5/31/22, LPA requested licensee to forward the email that was sent to LPA. To date, LPA has not received the requested email. 3) During today's inspection, LPA observed an aide left the facility, leaving licensee and two staff members. One staff member was in the office asking LPA questions. LPA observed licensee walk into the kitchen and then return to classroom with 12 napping children. LPA walked into the classroom to verify that licensee was the only staff in the classroom with napping children. Per licensee, she left the classroom to get her lunch and she did leave the children alone. CONTINUED ON FOLLOWING PAGE Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are to be cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights. LPA Brannon informed director, Jessica Ramsey that this report dated June 10, 2022 document one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Brannon informed director, Jessica Ramsey to provide a copy of this licensing report dated June 10, 2022 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with director, Jessica Ramsey This report shall be made available to the public upon request. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

What does Type A vs Type B mean?

Type A. Serious citation. Imminent or substantial risk to children. The regulator requires corrective action immediately and may impose a civil penalty.

Type B. Lower-severity citation. Corrective action required, no imminent risk. The regulator monitors compliance on the next visit.

  • PERSONAL RIGHTS

    Personal Rights. The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature. This requirement was not meet as evidence by LPA's observation of licensee using an aggressive communication style when raising her voice to be heard across the classroom when speaking to day care children. This is an immediate personal rights, health and safety risk to children in care. This is the second incident that LPA observed in facility.

  • 101212(d)(1)Type B

    Reporting Requirements. Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1), a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not meet as evidenced by LPA did not receive notification of licensee closing her facilty for two days due to two staff members having the flu. This is potential personal rights, health and safety risk to children in care.

  • SIGN IN AND SIGN OUT

    Sign In and Sign Out. The person who signs the child in/out shall use his/her full legal signature and shall record the time of day. This requirement was not meet as evidenced by LPA's observation that sign in/out forms were not completed as requested. This is potential personal rights, health and safety risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility for Providing Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not meet as evidenced by LPA's observation of licensee leaving 12 napping younger preschool children alone while licensee went into the kitchen to get her lunch. This is an immediate personal rights, health and safety to the children in care. This is an immediate civil lpenalty of $500 and $100 per day until corrected.
