PERSONAL RIGHTS
Personal Rights. To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by interview findings reflecting that not all parents were informed of children having a communicable disease. This is an immediate risk of personal rights, health and safety to children in care.

Accountability: The licensee, whether an individual or other entity, is accountable for the general supervision of the licensed child care center and for the establishment of policies concerning its operation. This requirement is not met as evidenced by interviews reflecting that licensee, Melissa Pershall, used unbecoming language in front of children in care, when addressing staff. Licensee was previously cited on 2/23/22 for the same citation. A civil penalty has been issued. This evidence was not met as evidenced by interview findings. This is an immediate personal rights, health and safety risk to children in care.

PERSONAL RIGHTS
Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by interviews conducted reflecting that licensee, Melissa Pershall, did pull a child’s hair and used threatening, humiliation tactics on a child who wet/dirtied their clothing. This is an immediate personal, health and safety risk to children in care.

Food Service. The minimum amounts of food components to be served as supplemental food as set forth in paragraph (a)(3) of ...[7 CFR, Part 226.20, Revised January 1, 1990] are as follows. Select two of the four food components. This requirement was not met as evidenced by interviews conducted reflecting that licensee, Melissa Pershall, was informed that one food group with water does not meet Title 22 requirements, however, licensee continued to serve snacks with one food group with water. Licensee informed staff to provide another food group when Licensing was present in facility. This is an immediate personal, health and safety risk to children in care.
