What the inspector wrote

On 04/12/2024, Licensing Program Analyst (LPA) Anita Tristan and Licensing Program Manager (LPM) Cynthia Brannon conducted an unannounced complaint inspection to provide findings for the above allegations. LPA and LPM met with Licensee, Kelly Oliver. LPA Tristan reviewed the allegation, toured the facility, inside and outside. A census was taken where LPA and LPM observed 4 children in the front day care room. Also present was licensee's adult son and daughter. Based upon LPA Tristan’s observations and information gathered through interviews, the preponderance of evidence standard has been met, therefore the above allegation; staff does not transport children in car seats is found to be SUBSTANTIATED. Per California Code of Regulations, Per Title 22, Division 12, Chapter 3, the following deficiency Type B is being cited (see 9099-D) Exit interview conducted with Licensee, Kelly Oliver and Appeal Rights were given and discussed. A notice of site visit was given and must remain posted for 30 days.

    102417(k) Operation of a Family Child Care Home- (k) All vehicle occupants must be secured in an appropriate restraint system. This requirement was not met as evidenced by: Based on interview with Licensee the proper seat restraint system was not used when transporting children in care. Per California Highway Patrol State Law Children under the age of 8 years old must be secured in a car seat or booster seat in the back seat. This poses a potential risk to the Health, Safety and Personal Rights of children in care.

    102417(a) Operation of a Family Child Care Home- The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence…. This requirement is not met as evidenced by: licensee had 17-year-old minor transporting children in care; in addition, the vehicle did not have the proper child seat restraints. This poses a potential risk to the Health, Safety and Personal Rights of children in care.

    HSC: 1596.87 (C)(1)(A) - Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision (f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by:Based on observation and interviews the licensee did not comply with the section cited above, which poses an immediate health, safety or personal rights risk to persons in care. Licensee's two adult daughters have been on the premises and assisting with the care of the children.
