What the inspector wrote

On 06/11/2024, Licensing Program Analyst (LPA) Miguel Herrera conducted a Plan of Correction inspection. LPA met with Licensee Guadalupe Davila, who accompanied LPA on a tour of the facility. Present during today\342\200\231s inspection were 5 children. The purpose of today\342\200\231s inspection was to verify that the deficiency issued during the inspection on 06/06/2024 has been corrected. On 06/06/2024, the facility was issued a Type B citation in violation of California Code of Regulations 102417(g)(5)(A) because the pool did not have a fence that met regulations. LPA observed the pool gate was not self-closing and self-latching as the latch bolt was broken. The pool gate was closed by a copper wire tie as a temporary fix. Furthermore, the rod iron fence was 4 feet tall, and a lattice was secured by zip ties to the iron fence to extend the overall fence to 5 feet in height. However, the lattice extended to the ground which provided children support to climb the fence by putting their feet in the diamond openings of the lattice which posed a potential health, safety, or personal rights risk to children in care. The new mesh fencing is bolted to the concrete floor and is attached to the home\342\200\231s wall in one side and in the other side it is attached to the home\342\200\231s brick wall. The surrounding fence is a southern facing brick wall, which connects to a wooden fence in the western side of the property. In the northern side of the property there is a wooden fence that is attached to the home\342\200\231s wall. The pool is enclosed in all sides of the property, and the mesh fencing separates the play yard to the pool area on the western side of the property. The mesh fencing does not obscure the pool from view. LPA took measurements of the height of the fence, any openings in the fence and the space between the bottom of the fence and the concrete. The mesh fencing was measured at five (5) feet tall. LPAs observed the mesh fencing was installed on concrete. The mesh fence posts sit inside tight pvc fittings that are drilled into the concrete. LPA observed the fence door opens away from the pool and is self-closing and self-latching. The latch is located within the top 6 inches of the pool gate. LPA Herrera advised Licensee to regularly maintain the fence as weather, and normal wear and tear can degrade the fence. Licensee Davila understood the responsibility of maintaining the pool fence/gate. The day care room has one window facing the south side of the property which is in the backyard. The window directly leads to the home\342\200\231s A/C unit which is enclosed by the pool fence and a 3-foot vinyl fence. Licensee is aware of child safety around the pool and assumes all responsibility. The mesh fencing meets Title 22 regulations and Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, no deficiencies were observed today. Exit interview conducted with Licensee, Guadalupe Davila. A notice of site visit (LIC 9213) was given and must remain posted for 30 days.
