What the inspector wrote

Licensee said at 5:25pm when C1 's parent arrived to pick up C1 is when she realized C1 was missing. Licensee said C1 told her that they got out of the vehicle and attempted to get into the home. After C1 was unable to get into the home, C1 decided to walk home. C1 was located at 4:38pm by a passerby .2 -.3 miles away from the facility. During the course of the investigation LPA Chavez requested and obtained records pertaining to the incident, and after reviewing the records, the timeline provided by the licensee did not match the timelines observed in the records. The licensee admitted not reporting the incident to the Department as required. Based on observation, record review and interviews, the preponderance of evidence standard has been met; therefore, the allegations are substantiated. LPA Laura Chavez informed licensee Evangelina Aguilar that this report, dated March 27, 2026, documents two Type A citations. Type A citation(s), which shall be posted for 30 consecutive days, as there is an immediate risk to the health, safety, or personal rights of children in care. LPA Laura Chavez informed the licensee to provide a copy of this licensing report dated March 27, 2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. An exit interview was conducted, and the report was reviewed with the licensee, Evangelina Aguilar. A plan of correction was discussed. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.00.

    Reporting Requirements - The licensee shall report to the Department any of the events as specified in HSC Sections 1597.467(b)(1)(A) through (b)(1 )(C) that occur during the operation of the family child care home. Any absence means any instance where a child in care is missing. For example, any child in care who wanders away from the family child care home, is lost during an outing, or does not return from school, shall be reported even if the child is later found safe. This requirement is not met as evidenced by: The licensee failing to report C1 wandering away from the facility without her knowledge.
