What the inspector wrote

An unannounced case management inspection was conducted today at 11:08am by Licensing Program Analyst (LPA), Sydney Sims. LPA met with Site Supervisor Summer Shults. In response to an unusual incident report received by the department on 02/26/26 where there was an inappropriate interaction between child C1 and C2 in the classroom under a table . The site supervision was interviewed on 03/05/26 at 11:30am and stated that on 02/24/26 that child C1 and C2 were playing in the classroom and engaged in a inappropriate interaction under the table and that staff S1 observed the incident and intervened immediate . Site Supervisor stated that there was a small book shelf blocking the direct sight of the table but the book shelf has been moved. Site Supervisor stated that there was four staff and 13 children present at the time of the incident and that the facility was in ratio and staff were providing supervision. Four Staff (S1 -S4) were interviewed on 01/21/26 and S1 stated that S1 observed the incident and intervened, S1 stated that S1 did not see the children go under the table because there was a book shelf in the way but that S1 was right next to the area with the the table and was able to look over the book shelf and observe the children. S2 - S4 stated that they did not observe the incident but that S2 - S4 were in the classroom engaged with other children when the incident occurred. S1 - S4 confirmed that the staff were in ratio and providing supervision. During today\342\200\231s inspection, the facility was toured, interviews were conducted with staff, and time cards and sign in records were reviewed. While touring the facility LPA Sims observed that the book shelf had been moved and that kitchen play area has direct line of sight. LPA observed that the facility was in ratio on on 02/24/26. Based on interview and record review although an inappropriate interaction occurred between C1 and C2 it could not be determined that a regulation violation occurred. Exit interview conducted and report was reviewed with the Site Supervisor Summer Shults . Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
