What the inspector wrote

On 8/18/2021, Licensing Program Analyst (LPA) Theresa Marquez conducted an unannounced complaint inspection and met with Director Deana McCoy. LPA discussed the above allegation, toured the facility and a census was taken. LPA observed 69 day-care children present. LPA interviewed the Director, Deana McCoy. During todays inspection of all 4 classrooms, LPA Marquez observed on or about 4 of the 69 children present wearing masks. Based upon interview conducted with the Director it is revealed that this preschool is not requiring mask wearing and instead allowing "parents to make the decision as to whether their student(s) wears a mask. The center will neither encourage or discourage the wearing of masks. Nor will we police the wearing of masks)." Based upon LPAs observations and information gathered during the interview, the preponderance of the evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations; Title 22, Division 12, Chapter 1, are being cited on the attached LIC9099D.

This requirement was not met as evidence by observation. LPA observed 4 of 69 children present not wearing mask while indoors.
