What the inspector wrote

Based on the information obtained during interviews, the preponderance of evidence standard has been met, therefore the allegations are found to be SUBSTANTIATED. Title 22 Regulation deficiency cited on attached LIC9099-D. Appeal rights were discussed, and a printed version was provided. LPA Sierra informed Facility Representatives, that this report dated 04/30/25 documents two type A citations. Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. Also, LPA Sierra informed facility representatives to provide a copy of this licensing report dated 04/30/25 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. An exit interview was conducted in which the report was reviewed and discussed with facility representatives, Glenda Robinson and Brian Winnick . Notice of Site Visit posted LPA also learned that hat cell phones are being used by staff for personal use preventing staff from providing 100% supervision to children. However, it has not been determined that children sustained injuries as a result of the cell phone use. Interview revealed that facility keep a diaper log and checked diapers every two hours and change them as needed. B ased on the information obtained through documentation and interviews; Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.     101216.3 Teacher-Child Ratio(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirements was not met as evidence by: Interviews revealed that staff had stepped out to a different room to change a diaper leaving the classroom with one staff and more than 12 children.This is a deficiency that if not corrected poses an immediate risk to the children in care.

  • PERSONAL RIGHTS

    101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitivenature...... This requirements was not met as evidence by: Interviews revealed that staff had placed children in highchairs for time out and that staff#1 yelled at Child#1 when trying to enforced child#1 to follow rules.This is a violation that if not corrected poses an immediate risk to the chidlren in care.
