What the inspector wrote

On 06/24/2024 , Licensing Program Analyst (LPA) German Negrete conducted an unannounced inspection at the above mentioned preschool to deliver the findings of the complaint allegations received by the department on 3/27/2024. LPA met with Director Marion Levin, LPA toured the center inside and out. LPA observed 3 preschool teachers providing care and supervision to 30 children. During the investigation the center revealed there was a unusual incident reported to the facility by a parent. The parent had concerns about their Child (C1) and another child (C2). The parent stated that C2 inappropriately touched their child (C1) in the restroom. The parent communicated this to the preschool director on February 15th 2024. According to the director the center conducted their own investigation. However the center failed to self report the incident to Child Care Licensing. Therefore the preschool did not meet title 22 CCR reporting requirements and is found to be in violation of California Code of Regulations section 101212 (see LIC809-D Page). Furthermore during the investigation LPA interviewed staff, both current and former staff. LPA found inconsistencies with the care and supervision this facility provides to children. Staff interviews revealed how staff don’t restrict the amount of times children can go to the restroom. Also staff stated how they utilize walkie-talkies to communicate to other staff when a child goes to the restroom. Director stated, preschool complies with teacher to child ratios, therefore the staff stays with in compliance Title 22 requirements pertaining to rations. However there was evidence found by the department how staff don't always verify if there is a staff waiting to receive a child at the restroom. LPA could not verify how staff keep constant care and supervision both before a child enters a restroom and after a child leaves and walks back to class(see LIC812). LPA received a signed declaration stating this preschool does not keep constant supervision on the children when a child leaves the classroom and walks to the restroom and when a child leaves the restroom and walks back to their assigned rooms. Continued on LIC809-C The Facility will receive a type B violation for Deficiency#1 reporting requirements (see LIC809-D). The Facility will receive a type B violation for Deficiency#2 care and supervision (See LIC809-D). E xit Interview conducted and report was reviewed with Director. . Notice of Site Visit and appeal rights were issued.

  • 101212(d)(1)(a)Type B

    Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met due to LPA conducting staff and director interviews pertaining to a unusual incident, 02/24/2024 . Parent informed preschool that there child was being innapropriately touched by another child in the restroom.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met due to LPA conducting staff Interviews. LPA found inconsitencies to the childrens bathroom break policy and the steps staff take to follow the guidelins. Also LPA obtained a signed declaration of how staff allow childen to walk to and from the bathroom unspupervised.
