What the inspector wrote

On October 17, 2022 at 12:44 PM, Licensing Program Analysts (LPA) Rona Chavez conducted an unannounced Annual/Random inspection. LPA met with licensee Janet Lindquist and advised the purpose of the inspection. Director provided LPA a tour of the center inside and out. There were 52 children in care at the time of the inspection and ten staff. The center operates from 7:00 AM to 5:30 PM Monday through Friday. This is a combination center with a infant program. All required licensing forms were posted in the office and classroom of the center. Each class had posted daily schedule and menu. Center provides lunch and snack to children who purchase meals. Children have the option to bring lunch from home and lunches are properly stored. The center uses four classrooms for the preschool. The restrooms were found clean and free of toxins. LPA observed a working carbon monoxide/smoke detectors in each class. Center has a sufficient amount of toilets and sinks for children in care. The outdoor play area is completely fenced and LPA observed age appropriate toys, equipment and shade. Drinking water is available inside and outside. Director stated she is not currently providing Incidental Medical Services. LPA observed the sign-in/sign-out sheet current. LPA reviewed a sampling of children and staff records. Children records were complete and current. Cont on 809-C LPA verified SB 792 Child Care Adult Immunization and Tuberculosis Requirements. Staff present were fully qualified with current Mandated Reporter Certificates and CPR/First-aid expiring on 9/2024. The last fire drill was completed on 10/13/2022. Facility is following current Covid-19 guidelines. LPA provided director information and resources for lead testing requirements. On 10/17/2022 - During staff record reviews, LPA observed one (1) staff present and supervising children has not received a cleared criminal record clearance or exemption. LPA informed Director about the staff that did not have a cleared criminal record clearance or exemption. Director stated she was unaware that she was not cleared and confirmed with other staff that they did not have the required paperwork in her file. Staff has been working since July of 2022. Director stated that their employee who did the records left and they were trying to get everything completed. LPA observed director send a staff member to the class room and sent S1 home and advised that she could not return until clearance is received. All individuals subject to criminal record review are required to have a criminal record clearance or exemption prior to working, residing, or volunteering in licensed facility. The following California Code of Regulations, (Title 22, Division 12 & Chapter 1) are being cited on the attached LIC809D(s) with a civil penalty. One type A violation was cited during today's inspection. LPA Chavez informed Director Janet Lindquist that this report dated 10/17/2022 documents one (1) Type A citation(s) which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Chavez informed the Director to provide a copy of this licensing report dated 10/17/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate c ivil penalty of $100. Exit interview conducted and report was reviewed with the Director Janet Lindquist . .
