Inspector’s narrative

What the inspector wrote

Administration by S1 and S2 in February of 2023 detailing the mistreatment/physical abuse of children in care, namely C1 and C2, by S3, a former teacher of the CCC. Based on LPAs observation, record reviews and interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulation, (Title 22 Division 12 and 101223 (a)(3), is being cited). As noted previously, the allegation of this Compliant mirrors, and is the same as an allegation received by CCLD on 6/26/23, which was addressed by a Type A Deficiency on 9/7/23. As such the CCC will not receive any additional Type A Deficiency for the same Deficiency . Further, the CCC submitted a Plan of Correction for the Deficiency which was accepted by CCLD. A closing interview was conducted with Director. Director was provided and advised of their right to appeal (LIC 9058). A copy of this report was reviewed and provided to the Director The Notice of Site Visit (LIC 9213) was also provided to the Director as required by H&S Code Section 1596.817. The Notice of Site Visit must remain posted for 30 days or a civil penalty of $100.00 may apply. care which was brought from their homes. S3 informed CCLD staff the food sampling/eating was performed to gauge the temperature of food for children, prepared by the parents. Further, the CCC Director verbally addressed and warned S3 of disciplinary action for consuming the food of children in care in the future. With respect to taunting, a written declaration was provided to the CCC's Administration by staff in February of 2023 detailed S3 teasing and calling children in care out of their respective names. Based on LPAs observation, record reviews and interviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulation, (Title 22 Division 12 and 101223 (a)(1) and 101227 (a)(14), are being cited on the attached LIC 9099 D). A closing interview was conducted with Director. Director was provided and advised of their right to appeal (LIC 9058). A copy of this report was reviewed and provided to the Director. The Notice of Site Visit (LIC 9213) was also provided to the Director as required by H&S Code Section 1596.817. The Notice of Site Visit must remain posted for 30 days or a civil penalty of $100.00 may apply.

    (a) The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as S3 taunted children in care as evidenced written declarations of srtaff provided to the CCC's Administration in February of 2023. This poses a potential health, safety or personal rights risks to persons in care.

    (14) All persons engaged in food preparation and service shall observe personal hygiene and food- service sanitation practices that protect food from contamination. This requirement was not met as S3 sampled/ate the food of children in care, which was brought from their homes. This poses a potential health, safety or personal rights risks to persons in care.

  • REPORTING REQUIREMENTS

    Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1)...(C) Any unusual incident... that threatens the physical or emotional health or safety of any child. This requirement was not met as Director/CCC staff failed to report an unusual incident to CCLD pertaining to S3 sampling/eating children in care food from home and S3 taunting children in care. This poses a potential health, safety or personal rights risk to persons in care.
