What the inspector wrote

LPA contacted the reporting party (RP) to gather more information regarding the complaint. RP states child's (C1) usual hours of attendance at the center are supposed to be from 6 AM to 4 or 4:30 PM based on the contract that was signed. According to RP, teachers call her to pick up her child at 11 AM because he does not want to nap and sometimes has potty accidents. RP also states the teachers do not have activities for the children and they do not redirect the children to other things when they do not want to nap. RP believes the new teachers are not qualified because she sees them (teachers) sitting around and not interacting with the children. Eight parent Interviews were conducted, and it was determined by LPA, all parents felt the care and supervision was either good or great and did not have any concerns. One parent also expressed her child enjoys attending the day-care and enjoys eating the food that is served. No parents complained about teachers not providing adequate supervision. Six staff interviews were conducted, and LPA determined all staff present knew the protocol and what to do when a child is injured. It was also determined by LPA, when staff has a child with behavioral issues, they first try talking to the child and if the behavior continues, parents are notified. Children with behavioral concerns are usually handled by the director. LPA asked all staff how the center deals with children who do not nap, staff members stated they provide alternative quiet activities. Interviews also revealed that the food provided for the children in care is prepared by a staff member who has a certificate of achievement for California Food Handler which is valid through 10/10/2025. LPA interviewed site director and it was determined that C1 was in the process of being assessed by the Fillmore Unified School District. LPA obtained documentation showing proof that the child was in the process of being assessed during the summer, but due to C1 being absent for the entire month of July and most of August, the assessment results have been delayed. Continued on 809-C Director admits a plan to have C1 picked up by 11 AM was verbally agreed by RP. Director stated this plan was placed in effect during the summer while pending the results of the assessment to have a better transition for C1. Director provided copies of text messages between RP and director, where RP expresses difficulty picking up child at the agreed time of 11 AM. It was also observed that RP asked director to keep C1 through nap so that the child can adapt to the routine as RP might not be able to pick up C1 at 11 AM starting January. It was determined that the center cooperated with RP\342\200\231s request and have kept the child past 11 AM. During today's visit it was determined that the child is still enrolled and attending therapy based on the assessment results. The center has received a copy of the assessment, which LPA observed in child's records. Based on LPA\342\200\231s observations, interviews which were conducted, documents gathered and record reviews, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED . No deficiencies cited for today. Exit interview conducted and report was reviewed with the Director, Brenda Orozco and a copy was left. The Notice of SITE VISIT MUST REMAIN POSTED FOR 30 DAYS OR A CIVIL PENALTY OF $100.00 WILL APPLY.
