What the inspector wrote

On 03/10/2026, Licensing Program Analyst (LPA) Shane Loftus conducted an unannounced Case Management - Incident inspection at the above-mentioned Child Care Center (CCC) as a follow up to a self reported Unusual Incident Report (UIR) received by the Department on 01/27/2025. LPA met with Director, Debbie Blumenthal and explained the purpose of the inspection. LPA notes one hundred and thirty-nine (139) children are on site during the inspection along with twenty-eight (28) staff. On 01/27/2025, the CCC was made aware and reported to CCLD that S1 handled C1 in a rough manner. The Director explained that they were made aware of this incident by S2 and that P1 was also present during the incident. LPA notes P1 is not the parent of C1. Upon being notified of the incident, S1 was put on administrative leave on 01/27/2025 and their employment was terminated on 01/29/2025. Director informed LPA that C1's parents were informed of the incident on 01/27/2025. LPA was informed that C1 continued to be enrolled at the CCC until moving to TK at another facility. Given the CCC handled the incident appropriately, no deficiencies are being issued as a result of the incident. A notice of site visit was given and must remain posted for 30 days as required by H&S Code Sec.1596.817. The Notice of Site Visit must remain posted for 30 days or a civil penalty of $100.00 may apply.

This requirement was not met as evidenced by: Based on records review and interview, the unusual incident occurred on 01/27/2025 and was not reported to CCLD until 01/30/2025. This poses a potential health, safety, or personal rights risk to persons in care.

    101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time...This requirement is not met as evidence by: Based on records review and interview, the licensee did not comply with the section cited above in that C1 was left unattended outside the CCC's auditorium for approximately 1-2 minutes. This poses a potential health, safety or personal rights risk to persons in care. LPA notes this is a repeat violation within 12 months. CCC assesed a civil penalty of $250 per H&S 1548(2)(A).
