Routine inspection (3-year)·November 29, 2023

On November 29, 2023, Licensing Program Analyst's (LPA's) Susana Martinez and Veronica Diaz conducted an unannounced Required- 3 Year inspection. LPA's met with licensee Fatima Torres and advised the purpose of the inspection. Licensee provided LPA a tour of the home inside and out. There were six children in care at the time of the inspection along with two additional adults. Licensee operates M-F from 6 AM- 6 PM. LPA's observed a sleeping infant (C1) in a crib placed inside the dinning room. At 1:21 PM, LPA's observed C1 to be wrapped in a blanket. LPA advised Licensee that cribs need to be free of any loose objects and infants cannot be wrapped in blankets while sleeping. LPA asked Licensee how old C1 is, Licensee stated C1 is only a couple months old. LPA observed required licensing documents mounted on the wall inside the home. Fire and earthquake drills are being documented every six months. Last drill was conducted on 10/20/2023. Fire extinguisher 2A10BC mounted on the wall inside the kitchen. Licensee states she could not find the receipt. LPA reminded Licensee that the fire extinguishers needs to be purchased or serviced yearly and show proof. Carbon monoxide detector is located in the dining room and smoke detectors are located throughout the home. Alarms were not tested as children in care were napping. Children in care have access to downstairs room, one restroom, kitchen, living room, and back yard. Knives are being kept in a cabinet above counters to keep out of reach from children. LPA's observed a baby gate located at the bottom of the stairs. Children have access to toys that are age-appropriate inside and outside of the home. Back yard play area is enclosed and has plenty of bicycles, scooters, and activities. There are no bodies of water present at the time of inspection. During the tour, LPA did not observe any hazards/toxins items accessible to children in care. LPA reviewed five out of five children files. All children files were current. Licensee CPR/first aid is valid through 1/25/2024. Licensee was reminded a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter certification AB1207 every two years at www.mandatedreporterca.com . LPA provided Licensee information in Spanish regarding Mandated Reporter training. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA's asked for safe sleep logs for the infants in care. Licensee states she did not know what that was and has not been documenting the safe sleep checks. LPA's provided Licensee with safe sleep chart, LIC9227, and safe sleep FAQs in Spanish. Licensee advised there were no children in care that required Incidental Medical Services. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. During today's inspection one Type A, one Type B and three Technical Violations were issued. LPA Martinez informed Licensee Fatima Torres that this report dated 11/29/2023 documents One Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care. Also, LPA Martinez informed the Licensee Fatima Torres to provide a copy of this licensing report dated 11/29/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
