Based on LPAs observations, documents gathered and/or record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 or Health and Safety Code, are being cited on the attached LIC 9099D.

    REPORTING REQUIREMENTS

    101212: Upon the occurrence, during the operation of the child care center... a report shall be made to the Department... (1)Events reported shall include the following: (C) Any unusual incident... that threatens the physical or emotional health or safety of any child. This requirement was not met as evidence by: Based on LPA interview and record review, the licensee did not comply with the section cited as LPA has been told of incidents that occurred within the facility that needed to have been reported to CCL which poses/posed a potential health, safety or personal rights risk to persons in care.

This requirement was not met as evidence by: Based on LPA interview and observation, the licensee did not comply with the section cited as LPA observed a child hitting another and obtained knowledge of incidents through interview which poses/posed a potential health, safety or personal rights risk to persons in care.
